Supreme Court Rules, GBM Wins Back Parliamentary Seat

UPND Vice President Geoffrey Bwalya Mwamba has won back his Kasama Central seat in the Supreme Court.
Last year, speaker of the National Assembly Patrick Matibini expelled Mr. Mwamba popularly known as GBM from Parliament and subsequently declared his seat vacant for holding dual membership.
This followed Mr Mwamba’s appointment as UPND Vice President for Administration, a move which meant he had crossed the floor in contravention of article 71(2)C of the constitution.

    That is law in zed for you. They rule as they wish by reading any such similar case that happened in the 17th Century. I know what I am saying.
    How can this be?
    How could you have dual membership?
    How do you remain in the party you are fighting day and night?

    This Country is so pathetic to say the list. It is actually just shit amafi!

      @ master Ken am at pain. It does not need one to be lawyer to understand this. How can some one be loyal to two different organizations. As you have rightly said, how can some be a member of a party he/she is insulting day in day out? This is indeed an animal farm. I have never been puzzled like this and never seen a judgement of this nature almost my entire life.

        Isaac, do u realise that those MMD and UPND Deputy Ministers campaigned and supported PF in the 2015 elections and subsequent elections? How can a UPND or MMD member campaign for another party other than his? did they receive any sanctions? NO! But because GBM is supporting PF u want him punished? the court in my view was absolutely right in its judgement.

    GBM didn’t resign as member of parliament for kasama central constituency, but he resigned or religuished his ministerial position as Defense Minister . So he is still representing pipo of Kasama as kasama mp, period . Bravo my Judge…..

    There is nothing to be happy about naimwe ba UPND unless we read the whole judgement then we will be able to tell, not those few sentences in the article.

      But the writing is there in BLACK & WHITE, MATIBINI was simply being biased. Remember the supersonic speed at which RB’s immunity was removed by the same Matibini, because RB was not a friend of PF, but now that RB shares the same bed with Lungu, if the same immunity were to be debated in Parliament, you would see how Matibini would side with RB. Bias at its best.

    So we still have justice in our courts, I hope this judge wont be intimidated by one lazy bum who is used to see blood shed from innocent Zambians. He cant even control his cadres and has forgotten that politics come and go so is leadership. However, spilled blood will forever be in your records as a leader.

    Honestly , how could the speaker have made such a selective decision? Most MMD and UPND MPs are working as Ministers in PF but the speaker could not declare their seats vacant. If GBM had stopped receiving his salary. Let him claim for a back date in his salary so that he can use that money to give out to the poor voters. I mean the man is already rich. He , unlike other politicians , is not into politics in order to enrich himself. Those that are after enriching themselves are busy increasing their salaries while civil servant’s and students’ allowances are being scraped off. JUDGEMENT DAY IS COMING.11 th AUGUST.

    These are the same judges who resist the same courts becoz they know what they do. Look at Mutembo Nchito who doesnt want to sit on the same chair he liked to put his friends on. The judge would have compeled GBM to suport PF or choose between the two parties not belonging to two parties.

    Look at this senario. Our very own Siamenen Hon is UPND but is handling a senior position in Government. Was he told to reinquish his parliamentary seat. Hell no. So all we are seeing is the beggining of better days to come of course under the vibrant commune of technocrats known as UPND.

      You are the ‘ifikopo’ who cannot distinguish between a political party and government. PF is not government and government is not PF. An elected MP is a representative of the people and that is why the law is explicitly clear that Ministerial positions (or govt) shall be appointed from Members of Parliament! Not ruling party.
      Sata, Mazoka and hakainde never understood this. And all opposition parties regard their member who serves in govt as a traitor? Ebukopo ubu.
