CHINESE Manager Says ‘I Am Not Familiar With Zambian LABOUR LAWS’

A CHINESE Manager has claimed that he is not familiar with the Zambian labour laws and therefore needs help to get acquainted.
This was after workers at the Chinese owned Jiangxi cooperation staged a protest urging management to honor the 50 percent salary hike awarded to the workers two months ago.
One of the workers, John Nkanda says the company awarded them a 50 percent salary increment two months ago but has up to now not honored it.
The workers also accused the company of effecting NAPSA deductions on casual workers dues for the past eight months. but Company site Manager, Lee Choir says the company is discussing with the workers on how best to resolve the matter.
He claims that he is not familiar with the Zambian labour laws.

Why not hire a Zambian HR manager to handle manpower or human resources related matters for the company?

He’s just trying to be funny. A salary increment in china means the same thing in Zambia and elsewhere. Let him honour the increment plus the deductions he has made on casual workers he has to give them back their money. And that speaks volumes, when NAPSA deductions on casual workers are made, why does that money go to? I dont think the government gets a ngwee from those deductions. Lipileni boss.

Even Zambian owed companies. No medical, housing allowance, funeral grant. No overtime and yet you work up to 21 hours and yet you are to knock off at 17 hours.

Fellow bloggers, charity begins at home. If you look at how these guys brutalise their labourers in their own country you will not be surprised that they are doing the same thing here. Talk of the boers, they are still largely practicing apartheid back in RSA so don’t expect much of a change there, either, especially where the manual labourers are concerned. The idea is to be vigilant and keep beating them back until the ‘assimilate’ into our labour culture, or what we want them to do! Epela.

This is bullshit, unless he tells us that all managment is headed by the f==king chinese we will not believe his excuse.

All foreign companies hire nationals to be part of management because they understand their countries laws and custorms. Infact its Zambians in those management who needs to be dealt with because they don’t advice the investors accordinly. Bu chinese wanga to bad.

  13. FRUSTRATED ZAMBIAN WORKER!!   November 18, 2011 at 11:50 am

My dear friends, I know it’s quite annoying to hear this Chinese Manager express ignorance of our labor laws. Nevertheless,we (Government!) are partly to blame…this is what happens when we don’t do much to enforce all our labours laws right from the very beginning…Also, we should note that it’s not only the Chinese that are guilty of this…there are Zambian companies out there that also have NO regard for labour laws.

Imagine a manager that is not in-tune with the labor lawz!he is either lying or telling the truth.
How do manage a business in a foreign nation without taking the time to learn the culture, Laws or rules that are governing in that country. Let the labor laws be read to him and he must be booked for every injustice engaged into by his management on the Zambian ppl

In the USA, you have to pass a written and oral test in your knowledge of the English language to be allowed to study or work there. In Zambia PACRA registers Chinese companies when they CAN’T EVEN EXPRESS themselves clearly in English which is our OFFICIAL language! Our officers are not familiar with our own laws!!!!

This is now a challenge to the ministry of Labor and social security. We do not need these foreigner claiming not to be eloquent with the Zambian labor laws all the time. Government must come up with a policy to have these foreign investors trained and taught the local labor laws before they are engaged in employing people. This will help all the parties involved to understand and abide by the labor laws. Some of the same employees do not even know their rights in the work places. Many are ignorant and hence such cases arising every now and then.

We cannot blame the Chinese on such matters concerning any country’s labour laws. Entry into Zambia is very porous, registrar of companies must do follow ups with every company registered and operating in Zambia. Migration is another key part that is not strict in permitting any jim and jack to entry the country and abuse Zambians. Whatever this company is, needs to employ a Zambian HR who will address such issues. This is one issue where HR associates in Zambia need to address. That for me is a vacant HR position which these associates can collect extra money as subscription. Wake up Zambians don’t just complain and expect everything to be free. The answers are just in front of you but you expect someone else to come and sort it out for you….utulo

China does not uphold International norms -(Human Rights) even in its own country. I am not excited about China’s rise and i believe its rise will not be peaceful considering teritotial disputes in South china sea (Spratly Island) and the Taiwan Issue. The strategic USA-Australia 21th century forward defence if not balancing against China is evidence enough that they don’t trust China’s military build up. if china takes over USA hegemony this world will be a chicken run. Can this Chinese Manager go to UNZA and do a short Labour Law course? There is no excuse for abusing the custodians of the Land.

  23. Framuka   November 18, 2011 at 2:18 pm

The MMD government did not put up safety valves to monitor the coming in of investors from China. Other investors came through the state house and did not even register hence cannot be aware of the labour laws since they came through the back door. Therefore, PF as government should take stock of all Chinese Investors including those that are cooking nshima for business and ensure that labour laws are availed to every Chinese Investor. This is a wake up call to remind us that the previous regime was not a caring government and left most of the national issues loose.
