GOVERNMENT has constituted a commission of inquiry to probe the alleged payment of K3.5 billion to George Kunda and Company when the former Vice-President was Minister ofJustice, the Daily Mail has learnt.
The K3.5 billion payment involves Sun Pharmaceuticals International and the Development Bank of Zambia (DBZ).
Mail investigations show that Minister of Justice Sebastian Zulu will head the commission of inquiry, which shall also investigate the K190 million paid to Mr Kunda by a wireless company.
“The terms of reference are to investigate the sum of K190 million which was paid to honourable George Kunda, State Counsel, and K3.5 billion paid to George Kunda and Company in the case involving Sun Pharmaceuticals International and DBZ,” Daily Mail sources said.
Other members on the commission of inquiry are Dr Ngosa Simbyakula (deputy chairman), and three members, Deputy Minister of Finance Alfreda Kansembe, Ministry of Justice Permanent Secretary Mbololwa Muyaba and Lusaka lawyer Mwila Kombe.
The commission of inquiry will be assisted by Emmerson Chawanda, Manson Gondwe and Ebby Katukula.
On Wednesday, Daily Mail investigations exposed Mr Kunda’s past dealings, including his law firm – George Kunda and Company- “inappropriately” receiving a total of K3.5 billion from Sun Pharmaceuticals Internationals and DBZ.
The payment traces its history to January 2010 when President Sata was then Patriotic Front (PF) opposition leader. It was first revealed on a programme aired live on QFM Radio.
The Daily Mail investigations revealed that Mr Kunda may face an official Government probe team to explain how the Ministry of Finance paid his law firm K3.5 billion without him declaring interest in the matter as a man who was working for the government and who also co-
owned the law firm.

At the end of the day, we should count how much money has been paid to the commissioners and how much they will bring in – in kind and financially. Those going to probe GK are mainly civil servants – are they going to be paid allowances, besides their normal salaries? Unless there’s much more about the facts than this article reveals, I do not agree with the ground upon which George Kunda must be probed for receiving money from DBZ and Sun Pharmaceuticals. If the payments were irregular then there’s cause to investigate, but if it’s for him merely not declaring interest then I have a problem. My South African experience is that every high profile public servant/politician would either at the time of assuming such office or at least annually be expected to declare ALL their business and financial interests as well as all remuneration/ financial benefit received at the end of each financial year (i.e.benefits accrued only by virtue of being shareholder but not performing extra remunerative work in those businesses). THEREFORE THESE CONDITIONS MAKE IT PRACTICALLY IMPOSSIBLE TO BE PERMITTED TO PERFORM EXTRA REMUNERATIVE WORK OUTSIDE ONE’S PUBLIC SERVICE JOB. But if allowed, these public servants would then be required to DECLARE INTEREST IN EACH OF THE INDIVIDUAL TRANSUCTIONS BETWEEN GOVT INSTITUTIONS AND THEIR COMPANY ONLY WHERE SUCH TRANSUCTIONS ARE PERSONALLY HANDLED BY THE PUBLIC SERVANT.

To be honest, may be there’s alot more you know about the Kunda issue that just what Tumfweko has reported. My comments are purely based on the contents of this article and nothing else. It’d obviously be foolish and unpatriotic for any well meaning Zambian not to support the fight against corruption, but I have a problem with what Tumfweko reports to be the reason for police’s pursuit of Kunda (i.e. ” … his company received K3.5Bn without him declaring interest in the matter…”). And my argument is that these grounds are weak for govt to send him to jail. If you go through Kunda’s ministerial file at Cabinet office or State House (wherever these records are kept) you’ll most likely find that he declared his interest in this company when he was taking up a ministerial post. And maybe in terms of the Ministerial Handbook, this declaration suffices for the full duration of his appointment. During Kunda’s term as either Justice Minister or Deputy President his firm had numerous transuctions with different clients, some of them govt entities. Now, the question is; did he have to declare interest in each of those transuctions?? Mind you we are dealing with a lawyer here, so they must not excite us now and then go into oblivion later when they fail to convict him after wasting more govt resources!
