Suspension of Judges Might Erode The Judicial Confidence In The Country- Bishop Musus

Former Evangelical Fellowship of Zambia Executive Director Bishop Paul Mususu says the suspension of the three Supreme and High court Judges confirms the need for separation of powers in the governance system of the country.

Bishop Mususu says the situation where the head of State is empowered to make such decisions might erode the judicial confidence in the country.

He says justice system might be compromised if such powers are left with the president.

He says judicial matters are some of the issues that need to be addressed in the constitution.

Bishop Mususu has also hoped that the tribunal set up by the President will not raise concerns of a pre-determined outcome as has been the suspicion with the commissions of inquiry.

Bishop Mususu explained to QFM news this morning that the tribunal should act in a very fair manner in order for fair justice to prevail.

    Bishop,

Contrary to your arssertions, the action by MCS will in the long run boost the confidence and respect for the judiciary. Some judges have been behaving as if they are a law to themselves. One has to look at the Chiluba acquittal, the DORA Zamtel saga, the list is endless. These has led to low esteem of the courts. As a matter of fact, this action must be extended to Magistrates. Go on MCS! Stop the rot & clean up the MMD mess.

The action is okay. They have been a lot of complaints against the Judiciary.look at what they did to the fellow lawyer, they jailed for nothing. Is it Mr Sambo?I cant remember his name anyway. In fact we need a reform like Kenya did.No sympathy at all to this guys.It is only in Zambia where you can be sent to jail for commenting on a case before the court of law.why should a qualified judge be swayed by the comments in the media.Terrible.

Man is incapable of real justice we delude ouselves in thinking we can adminster justice impartially. Man will always shift the goal posts to suit him/herself if it affects him or her. We have seen this with our own constitution it has always being changed to suit someone mostly the ruling class. We are unable to produce a constitution that will stand a test of time.
Look here fellow country men and women, with mankind the payment of a fare is not enough you need to be issued a ticket, doors are not enough you need to lock them with many locks, a promise is not enough you need to sign a contract because people are not just in general including those who perform these judicial function. If you expect justice from human beings you deceive yourself it depends on who you are at that time period.

This shows that educated people should go into politics otherwise grade seven presidents will be messing them up like this. What does Ukwa understand about the judiciary? All he thinks is that Zed is his farm to do as he pleases with. Wait and see what he’ll do to the draft constitution.

too bad!!!. a country bein run from bwinjimfumu. so can someone kindly explain. should in this case DBZ just forget about the k14Billion it is been owed. how many innocent zambians have been sent to jail all for nothing but lack of connections to the corridors of power. granted Nigel Mutuna the judge misdirected himself when he orderd that DBZ be paid whats owed, does this warrant such action by the president or maybe an appeal would do by the party which felt justice has been denied.how about walking out of court like parliamentarians who feels overpowered would do instead of fighting a losing game. how about the purpoted connections of the Laz president to judge wood who the guys cried loud when he was removed from handling the matter. legal experts please explain. if these judges are in the wrong i have a million reasons to believe its the entire system involved and must be overhauled. so really, this step is so much in the short term and i hope a lasting one would be availed soon. then we can say and believe that yes viva MCS

Pipo are just saying the action is ok, confidence, blah, blah blah. What about the K14b which the trio are trying to get away with. That is the exact kind of mentality that is impeding development in Zambia/Africa. We have to be accountable for tax payers money. Both sides may be wrong in this case. Please let us not take sides blindly as if this is football. Lets unite and root out corruption and evil wherever it may be. The trio need to be held accountable for the K14b plus interest and they should give up public jobs.

There is no confidence in the judiciary, Bwana Bishop. Where have you been? This kind of move by HEMCS might infact start to put some confidence in the judiciary. It is the people who want this change, not just MCS or PF. Be careful how you fight Sata, because you might end up going against the people’s will in the same stroke, and thus lose your relevance, just like HH and MMD are doing. They seem not to realize that by fighting Sata they are stepping on issues which many people among the electorate feeling strongly about, and as such they are alienating themselves from the voters. People are supposed to be thinking of what is in the best interests of the majority, not their petty sentiments against PF and Sata. You won’t get popularity or votes by fighting Sata. You will get these things by winning the people through representing what they feel they need, and a clean judiciary is one of those things, so whatever your feelings against Sata, keep the focus.

This action has been long overdue to restore people’s confidence in the judiciary . The rulings in the Chiluba cases and Dora (GWAT) were all made in the state house. These and stories of judges collecting building material from supplies in town for free – they say no smoke without fire.

Unfortunately a few bad eggs are messing up the whole judicial system.
