FORMER Minister of Justice Sebastian Zulu obtained the letters of administration for his late wife’s estate without consulting the beneficiaries, the former cabinet minister’s step-son Dominic Nzumba, has revealed.
Two weeks ago, the former Cabinet Minister, in his capacity as administrator of the estate of Loveness Zulu, his wife, sued Mr Nzumba, accusing him of illegally staying in the family house without paying rent.
Mr Zulu said his late wife Loveness, who is the mother to Mr Nzumba, built a house in Kanyama site and service in Lusaka but his step-son has been occupying the house since September 1, 2009 without paying anything.
But Mr Nzumba said in his defence and counterclaim filed in the Lusaka High Court, that the letter of administration, given to Mr Zulu should be revoked because he did not get the consent of all beneficiaries.
“The defendant (Mr Nzumba) is claiming an order that the plaintiff’s (Mr Zulu’s) letters of administration be revoked as he obtained them without consulting all the beneficiaries of the deceased’s estate,” reads part of the defence.
Mr Nzumba is further claiming an order that he is entitled to occupy his mother’s house because is a lawful beneficiary, costs and any other remedy the court will deem fit.
He said he will prove during trial that Mr Zulu went behind the beneficiaries’ backs and “fraudulently obtained his letters of administration without consulting the family.”
Mr Nzumba said it is not true that he was asked to move out of the house when Mr Zulu became administrator.
He said he moved out of the house due to illness and he wanted to be near a clinic.
Mr Nzumba said he did not need to persuade Mr Zulu to stay in the family house because his mother had already granted him that privilege without paying rentals.
In his statement of claim, Mr Zulu is claiming an order for vacant possession of stand number 992 Kanyama Improvement area, Lusaka the property of Mrs Zulu which the defendant (Mr Nzumba) has allegedly wrongfully been occupying since 2011.
He is further claiming profits at the rate of K1 million from September 1, 2009 to June 30, 2010 when he (Mr Zulu) took possession of the house as administrator and during this time Mr Nzumba did not pay anything to his older sister Clare Nzumba-Daka who was then administrator.
Mr Zulu is also claiming K750, 000 rentals for the month of November 2011 and profits at the rate of K1 million per month, with effect from December 1, 2011 to the time Mr Nzumba will give up possession of the property.
The former Minister of Justice is further claiming interest on the sums of money found to be due and payable and costs.

The big man should be careful not to air dirty linen in public. Family is family n peace is more important than money. I believe this is not the wise way of dealing with family disputes. He should have planned better for his retirement . He now want to use his step-son as a cash cow. Shame.

now i understand, zulu is trying to serve the interests of his daughter, who happens to be the daughter of nzumba’s mother. the continued occupation of that house by the brother means that his sister is not benefitting from their mother’s house. this case should have been rsolved at family level. the house should have been put on rent and the revenue shared among the brother and sister, in lieu, the brother should pay a bit to the sister for rental. i think this is the issue

@Kolwe. Even if that were the case, this ChiZulu should have unified his children as one even before the wife died. I bet he’s one of those foolish men who segregate children from other men. He shouldnt make the girl feel more child than Nzumba.

@Kolwe, dispite the reasoning behind his sueing, the old man is wrong. If this be d interest of his daughter, he is still in d wrong. The daughter should have been d one to sue as u rightly said. Why get in the middle of sibling rivarly. He needed to play the role of a mediator n let the two sibling sort it out. The old fellow is a fool in my eyes.
