Former First Lady Thandiwe Banda Sues ACC

Former First Lady Thandiwe Banda has sued the Anti-Corruption Commission (ACC) over the allegedly unlawful seizure of apartments belonging to the Mpundu Trust Limited on Leopards Hill Road in Lusaka.

Mrs. Banda has filed the suit before the Lusaka High Court seeking compensation for damages suffered as a result of lost time on the real estate development project, the reversal of the restriction notice to lease or dispose of the property issued by the ACC against her property, as well as costs.

She wants in the alternative, the Court to annul the restriction notice and allow her to lease out the property and employ property managers.

The former First Lady filed an affidavit in support of originating summons in the Principal Registry through her lawyers of Central Chambers yesterday. She contended that Mpundu Trust Limited was established in 2009 to look after the interests of her children and their future education and health needs.

Ms Banda said ever since the notice was issued, she had never been informed of the alleged offence under investigation by the ACC which led to the seizure of property.

“I reasonably believe that no investigations are being conducted and the issue of restriction notices is an act of harassment and amounts to abuse of authority by the respondent. The restriction notice has scared any possible tenants in the project and the whole project is in jeopardy,” Ms Banda said.

Ms Banda said the issuance of the restriction notices was unreasonable and defied logic.

She said the Commission was well aware that the funding for the project was dependent upon the project being leased out and that she has not committed any crime in its acquisition.

        Do you have an idea what Maureen owns? Just shut up!! By virtue of one being exposed to such high offices mean exposure to assistance in kind from well wishers – worldwide for that matter.

        If an investor wants to come into the country to set up business, first he has to negotiate…and part of the negotiations MAYBE in kind as such above….

    When you are in politics, they are a business people who will support you just because they are gaining some mileage in their business. This is usually policy oriented. People will spend money to put and keep the person they want in power. That is really why the “supposed” investigation of MMD funds seems to be making no progress. If Banda and his people had just taken money for the lavish campaign from taxpayers’ money, I believe the PF, being so eager to prove Banda corrupt, would have made serious progress in these investigations. We would have been reading serious revelations from Namakando’s post newspaper. But if the Chinese investors and others wanted Banda to win and gave hime campaign material there is no crime there. Everyone has sponsors. eg PF and Mathani. I bet you ACC is stuck because Thandiwe’s money was similarly sourced.

    ACC/ DEC when alerted of possible crime such as this should place a caveat at lands not allowing transfer, then find out the circumstances of acquisition of said property, then charge the offender under correct section of the law, then quickly prosecute case, then if prosecution is successful they should request judge to confiscate said property. If a crime did not happen at the property and there are no dead bodies buried there then what gives?

    Do you know that in England there is a law that if you buy something for 10,000 pounds or more, no matter who you are, politician or not you have to explain the source of your funding or failure to which you lose the property to the state? And here when we try to do the same corrupt people cry murder!
