Detained UPND Mazabuka Central Member of Parliament Garry Nkombo has been admitted to the Livingstone General Hospital for a fractured arm and ribs sustained after he was allegedly physically attacked by North Western Province Minister Obvious Mwaliteta in the presence of police at Livingstone Central police station.
And Zambia Police Chief Inspector Nebert Chellamaumba was locked up in court cells by Magistrate Chola Musonda for failing to carry out a court order to issue murder suspect Mazabuka Member of Parliament (MP) Gary Nkombo with a medical report within 48 hours as ordered by the court last Friday.
This was when the case for Hon Gary Nkombo, who is charged with murder contrary to section 200 of the Penal Code chapter 87 of the Laws of Zambia, came up for hearing.
Last week, the defence complained that their client , Hon Garry Nkombo, was unwell after he was allegedly assaulted by Western Province Minister Obvious Mwaliteta. This prompted Magistrate Musonda to directe the station officer in charge to issue Mr Nkombo with a medical report within 48 hours.
Magistrate Musonda asked Nkombo if the police had given him a medical report following a court order last Friday but the Mazabuka lawmaker said he was not given.
This prompted magistrate Musonda to summon the criminal investigations officer but the court was told that the officer was out of station and Inspector Chellamaumba came to court to represent the police.
At this point, magistrate Musonda said he expected police officers to take court orders seriously.
“I have found that you disobeyed the court order. It is not the intention of the court to punish police officers but if you neglect your duty to implement court orders, this honourable court will not be shy to punish you,” Magistrate Musonda said after which Inspector Chellamaumba was led to court cells.
Magistrate Musonda has since directed Livingstone district prosecutions officer Jonathan Chenda, who was present in court, to immediately facilitate the medical report for Nkombo to receive medical attention.
However, Southern province Commissioner of Police Charity Katanga defended the Police saying that there was no written court order for the police to issue Nkombo with a medical report.
“We only learn’t of the magistrate’s directive through the media and there was no written court order as was done in one instance in Lusaka where a magistrate gave an instruction in court and followed it up with a written court order to the police,” she said.-Daily Nation/

This guy must have got himself in the fracas that led to the death of the PF cadre. What type of force did Mwaliteta use to warrant that kind of injury??? Broken arm and ribs. Ni accident or a very heavy fall.

It must be embarrassing for the PF to have a law maker in the name of mwalisomething busy breaking people’s ribs while the police are watching and cheering. It can never be worse than this. . But he should remember that his day of reckoning will dawn on him. And to imagine that the govt appears to be tolerating this. Nsoni. No wonder they are being investigated by other govts who see this as abuse and nonsense.

I am confused here. how does the police issue a medical report? isn’t the one injured supposed to get a medical report from a doctor after a medical examination? the police is supposed to give a police report. Since when did such simple and trivial laws change?

The doctor and other medical personnel always require a police report before attending to anybody with an assault case or even accidents. I think the writer should have said police report first and then medical report. At this stage the police are not involved in following up the results from medical people. Maybe in this case since it’s to do with politics.

The Zambia Police needs to evolve. they should stop seeing the citizenry as annimals who the have been charged to heard. this institution has is at the heart of human rights violations,abrogation of the very laws they serve and has continually failed to dicharge its functions. There is no one checking over this institution to who does it account?

Read and follow the story PROPERLY!! Mwaliteta attacked Nkombe when he (mwaliteta) found Nkombo at ZP who was registering a complaint about PF cadres having attacked UPND camp during the night when campaigns had hieghtened!!
It was a serious case and a very sorry sight!
