Court Hears How Nevers Opened Private Account In Canada

Nevers-Mumba-MMDA WITNESS has testified that a secret account was opened at the Zambian High Commission in Canada during Nevers Mumba’s tenure without the knowledge of other members of staff and authority of the Zambian Government.

Zambia’s former deputy high commissioner to Canada Nedson Nzowa of Lusaka’s Makeni area told chief resident magistrate Joshua Banda that the account had more than Canadian dollars 122,000 from Barrick Gold Corporation as a donation .

Mr Nzowa said he was also surprised to establish that payment documents different from the normal Government vouchers were designed specifically for purposes of the private account, an action he described as irregular.

This is in a case in which Mumba, 52, of 17 C Middle Way Kabulonga is facing four charges of abuse of authority of office and wilful failure to comply with applicable procedure relating to management of public funds, while serving as High Commissioner.

Mumba, who is MMD leader, is between June 1, 2011 and December 31, 2011 alleged to have wilfully failed to comply with laid-down procedures in receiving and disbursing of Canadian dollars 122,229.85, a donation to the Zambian Government from Barrick Gold Corporation while in Canada.

Mr Nzowa testified that he became aware of the secret account when he was informed by the High Commission liaison officer only identified as Carolina.

He was informed that there were two Canadians of Zambian origin asking her to make available files containing details of the cultural exchange.

The witness said he then asked Carolina if there was such a file and when she answered in the affirmative.

He asked her to show him the file and when he checked, he was surprised that the High Commission had received Canadian dollars 122,229.85.

Mr Nzowa said the two officials asking for the files, Dr Joseph Daka and Mable Chipasha were not Government officials but were signatories to the private account.

He called them to his office but they refused and this surprised him.

Led in examination-in-chief by Anti-Corruption Commission (ACC) prosecutor Silumesi Muchula, Mr Nzowa said all the information was availed to him by the investigations team that travelled there to conduct investigations.

He said he was showed other bank documents containing the transaction involving Canadian dollars 41,500 and another 80,729.85 containing Mumba’s signatures.

Mumba is in the second, third and fourth counts charged with abuse of authority of office contrary to Section 99 (1) of the Penal Code, Chapter 87 of the Laws of Zambia.

It was alleged that Mumba between October 1, 2009 and December 31, 2010 did abuse his authority of office by awarding contracts valued at CAD$ 9,000, CAD$19,850, CAD$5,248 for electrical works, carpeting and construction of a deck at his residence in Canada to three private companies without following laid down procedures.

The three companies are Restcon Construction Services, Argos Carpet Limited and Stanmark Construction.

Mr Nzowa said he also discovered during investigations that all the three quotations for Kitchen repairs were sourced by Mumba’s wife Florence and was only stopped after he intervened in the matter.

He said in the process of fixing, the accused person told him to intervene because the accountant had refused to pay Restcom but when he followed up the matter, he discovered that Ms Mumba had come up with additional works.

    ALSO ARREST THE TWO CANADIANS OF ZAMBIAN ORIGIN.THEY ARE PART OF THE SCHEME.THIS MONEY WOULD HAVE BEEN USED BY ZAMBIAN STUDENTS TO VISIT CANADA ON CULTURAL EXCHANGE PROGRAMS BUT MR NEVERS MUMBA DECIDED TO CHEW IT.

    There is nothing tribal about this just like there is nothing tribal about someone who benefited from privatisation and amassed their wealth, it is their personal weaknesses and poor decision making at some point.

    Usually, these are people who may have made a lot of good decisions and made significant contributions to society but just one or two decisions abrogated the law and that is it. You can not have other signatories to government resources, or that raised in the name of Government, pure and simple!!!
