A LUSAKA man has pleaded with the boma court to dissolve his two-year marriage because his wife does not acknowledge his children from his first marriage.
Fred Banda told the court that before he married his wife, Monica Mbewe, he told her about the three children he had in his previous marriage and one dependant but that she has refused to accept them as her stepchildren.
“She told me to choose between my children and herself and I have decided to choose my children. She started having problems with them barely three months after we got married,” Banda said.
He further told the court he wants to divorce his new wife and re-marry his former wife who he earlier divorced, saying she is a better wife.
But Mbewe, who could not dispute whether she hates her stepchildren or not, said it is her husband who has refused to accept her child from her previous marriage.
In passing judgment, the court granted them divorce and told Banda that minor problems in marriage should not lead to divorce, adding that if two people divorce, it is the children who suffer.
The court also asked Banda on whether upon reconciliation, his former wife would accept the child he has with Mbewe.
Banda was speaking before senior court magistrate Robert Zulu and George Kaoma in a case in which he sued Monica Mbewe for divorce.
They got married traditionally in 2011 and the two have one child together but Banda has three children in his previous marriage while Mbewe has one.
In giving her statement, Mbewe told the court that, when she went to her mother’s home to deliver their child, Banda used to send text messages on her phone telling her to come and get her child from the first marriage.
“My husband told my relative that he can not keep my child and that he wanted me to get my ‘rat’ child. I wondered why he chased my child from his home when I told him that I had a child before I got married to him,” Mbewe said.
She said her husband told her never to go back to her home after she delivered because he no longer loved her as a result of her cruelty on his children, adding he had nothing to do with their newly-born baby.
Mbewe said her husband’s family and hers sat down to discuss the way forward on their endless marital problems but that, the visibly drunk Banda was boastful and decided to use English in the meeting when he knew that her parents could only speak Nyanja.
“If my husband knew that he would divorce me, why did he impregnate me? How do I keep a three-month-old baby alone?” she asked.
The court in passing judgment, castigated Banda for marrying Mbewe when he still loved his former wife.
The court granted them divorce and ordered Banda to compensate Mbewe with KR3,000 starting with an initial payment of KR500.

@Alfred, it isn’t the woman alone who couldn’t care for her husbands childred, rather the man also couldn’t care for his yfez child. so who is to be blammed?

You have made a good decision bro!if she really loved u she was suppose to even love yo kids and i hope u have learnt something from that u just see a skirt, “ati nalaupa” mukaposa abana muma problemz reconcile with yo former wife and let the children be raised by u and the real mother.
