Court Refuses To Release RB’s Passport For Fear ‘He Might Run Away’

Chief resident magistrate Joshua Banda has this afternoon dismissed an application by former President Rupiah Banda’s lawyers to have his passport released, stating that the application was wrongly before the subordinate court.

Delivering ruling on the application, Magistrate Banda ruled that the application was supposed to be made before the High court.

Magistrate Banda made the ruling the ruling after analyzing submissions from the state and the defence team.

Magistrate Banda has also warned the public media and state advocates to desist from making commentary on the case of the former president which is still in court.

And in another court where the former president is charged with concealing of gratification under the Anti Corruption Act, Principal Resident Magistrate Obsitter Musukwa ruled that the former president should apply for the release of his passport through the High court.

Magistrate Musukwa told the court that only the high court is empowered to vary the jurisdiction.

And speaking to journalists immediately after the ruling defence lawyer Sakwiba Sikota said the next move will be made known after talking to their client.

President Banda is scheduled to travel to South Africa on the special invitation by Boston University by midday tomorrow.

    OMG!! I think he better forget about this trip. Maybe just going ahead with the application to the high court would be good for future outings(that’s if ruling goes in his favor)

    The same judiciary he manipulated to let Chiluba off the hook is now being manipulated by others in his former position to fix him, he should just enjoy his sour grapes in harmony and silence, asati ku lila lila cimuchembele chonse monga ka mutoto, ala!

      We cannot allow him just to go and meet with his interdicted lawyer called Amstedarm.Do not allow this man to go after all,this is the same judicialy he left and paraising.

    The head line is misleading ba editor. Where is it written that he was refused to be given the passport for fear that he might run away? However, RB is a flight risk. Once allowed to go out, he will go for good, so he must remain in the country. And those who invite this old man must stop because they are just interfering in the affairs of our country. Ba RB, akatanshi takalisha akalekelesha ekalisha.

    his head weighs more than 200 Kgs since he came out of power, might cause flight problems if given back the passport.

    The court stopping pipo to comment on case already in court meanwhile it was very easy for parliament to discuss RB’s case which was already in court. Double standards by our courts. Be professional and consistant in your execution of duty.

    This man should not leave the country not until he’s cleared mwebantu… it was really painful those days to see him waste our money on bena Dora, his sons & the sons girlfriends at the expense of poor Zambians…. please please please… this man should not even rest at all, & should face the law on a serious note

    If there is anyone amongst you who are calling RB a thief, and claim You have never committed any kind of crime, stand up and say yes “Im Here”, but if you have committed an atrocity today or even years back and you know deep down your hearts, Please give RB a break. He served you and served with with integrity. Some of you are hiding in condemning people like RB but you are busy sinning.
