Girl, 13, Explains Her Defilement Ordeal

A 13-YEAR-OLD grade eight pupil of Ganerton in Kitwe has told the Kitwe Magistrate’s Court how a 26-year-old garden boy abused her sexually in January this year.
This is in a case in which Kelly Masumba of house number 1213, Dolomite Street in Ganerton, is charged with defilement.
The offence is contrary to Section 138 of the Penal Code Chapter 87 of the Laws of Zambia, as read with Act number 15 of 2005 and Act number two of 2011.
Particulars of the offence are that Masumba, on January 27 in Kitwe, had unlawful carnal knowledge of a girl under the age of 16. He pleaded not guilty.
Testifying before Magistrate Maxwell Mainsa, the girl testified that on the fateful day, she was walking from school on her way to Zambia compound (home) when she decided to take her shirt to the tailor for mending.
The girl recalled that the tailor told her that he could not mend her shirt because there was no electricity and she headed home.
She testified that on her way home, she met Masumba, who convinced her to accompany him to his home.
“At Masumba’s house, we sat and started chatting, until it became dark and we went to sleep in his bedroom. He undressed me and had sex with me,” the girl said.
She said Masumba had sex with her four times on that night and no one rescued her when she screamed for help.
The girl narrated that the following morning, two women went looking for her and found her at Masumba’s house.
She told the court that the women took her along with Masumba to Ganerton Police Post, where she was checked.
“I explained the incident to the police and I was taken to Kitwe Central Hospital for examination,” the girl said.
In cross-examination by Masumba, the girl maintained that he invited her to his house and had sex with her.
Mr Mainsa adjourned the case to June 19, 2013 for continued trial.

But really how can a girl so easily follow a man to his home and sleep there? I suspect this girl had been doing it with him freely for some time, but this time the mistake the guy made was to let her sleep overnight!

I think this girl is a player!!! the court should call the doctor who examined this girl coz they will prove that this girl has been sleeping around long before the musamba took her,she is not an honest girl!!!

Some thing very fishy here, she went willingly to his house, chatted till it got dark, what can a 13yrs old chat about with a grown man who is not even her relative? This girl is a character because even my seven year old knows not to talk strangers. They are just lovers. Masumba naiwe, ka 13 year old- that’s “animalish”.

Eeh point is they have shagging for a long, problem is she slept over at his place. But Masumba is also a dull chap. Then how did those ladies end up at Masumba’s place if nothing has been going on between the two? I think her relatives knew about it but it just became too much. The girls testimony was under duress…period

The girl was underage. the gardener should go to jail. Whethe or not she “wanted” it, she is still a child, only 13 years old, still not capable of making adult decisions, the gardener should have known better and now he must suffer the consequences. law is law

Both are wicked. The girl is lying. It is likely that the girl was not given money so she opted to report the guy to the police. She says she was screaming, this is also a lie. Musumba’s house is not in the bush, people could have heard her screaming. From the story you can also deduce that Masumba was not a stranger to this girl. A well disciplined child can not go to a stranger’s house and chat until it is dark. Even the age I think this girl is also lying. A girl of her age would not have stories to talk to someone of that age for a long time. If it was in my power I would punish both. Punish the girl for being promiscuous and punish the guy for being a fornicator
