Chibombo Man Tells Court ‘I shot him in self-defence’

A MAN of Chibombo who is appearing in the Kabwe High Court with his two brothers on a murder charge has testified that he shot and wounded another man in self-defence at his village.
This is in a matter in which three brothers, Raydon Siame,, Jasper Siame and Kapufi Siame are appearing before Kabwe High Court judge Elita Mwikisa accused of murdering Boyd Chilwani.
The offence is contrary to section 200 of Cap 87 of the Laws of Zambia.
Raydon Siame appeared for defence last week and denied murdering Mr Chilwani, saying he shot at him in self-defence because Mr Chilwani and his brother Moses allegedly attacked him as he was going to his shop.
Siame (Raydon) of Chibone village in Chibombo testified that on September 25, 2012, the day he is accused of murdering Mr Chilwani, Mr Chilwani and Moses were the first ones to attack him by stabbing him in the shoulder and back.
“I decided to run away from them but they started pursuing me,” Siame said.
He said he ran as fast as he could and when he reached his village, he picked up his gun to face the two brothers.
He said he hid behind his house as the brothers approached from opposite directions. Moses allegedly fired his gun and he (Siame) shot back and wounded Boyd.
He said Moses fled and when he checked on the person he had shot, he could not recognise him.
“I went back to the spot where the brothers had attacked me to check for my bicycle so that I could go to the police but I did not find the bicycle,” he said.
Siame told the court that he started walking to Keembe police post to report the matter but on the way, he saw a police vehicle approaching from the opposite direction carrying Moses and some police officers.
He told the court that to his surprise, police fired a warning shot and he decided to flee and on September 26, 2012 he left for Kabwe early in the morning to report the matter at town centre police post.
He said police officers from Kabwe accompanied him to Keembe, where officers from the Keembe police post maintained that he murdered Boyd Chilwani and he was detained at Prospect Police Station.
He also told the court that on October 1, 2012 his brothers Jasper and Kapufi were arrested when they brought him food.
He said when he shot and wounded Boyd, Jasper and Kapufi were not with him.
Ms Justice Mwikisa adjourned the matter to June 26 for continued defence.
On February 21, 2013 Moses testified that the shooting of his older brother by Raydon arose from quarrels his family and the Siame family had been having.

    I smell a rat. I think this was not self defence.

    One of the element self defence is that the defence must be reasonable to the attacker therefore the brothers didn’t have a fire arm which makes it unreasonable

    Two guys against one man ? They stubbed him with a knife …….. He should have not shot them may be warning shots should have helped

      A knife is as good as a bullet when put in the right place. He should be having cut on his shoulder and other places am sure.

      He was defending himself, period! At your home, you can use an axe, shovel, hoe or even a gun if it comes cheap. Moreover, they were trespassing.
