FORMER President Rupiah Banda has for the third time failed to travel out of Zambia, this time to Tanzania for the Global 2013 Smart Partnership dialogue after State agencies could not release his passport on Friday.
The former head of state was to join other former Heads of States at the Dialogue, and these include Benjamin Mkapa of Tanzania, Joachim Chissano of Mozambique, and Jerry Rawlings of Ghana who are bestowed with the status of Fellow Emeritus due to their involvement with the Smart Partnership Dialogue.
This followed a latest court order allowing him to be out of the country for four days.
On Thursday Lusaka High Court judge Anesi Banda-Bobo ordered the State to release Mr Banda’s passport after the former president filed inter parte summons to vary bond conditions, and for an order for release of the passport pursuant to Section 126(3) of the Criminal Procedure Court.
Justice Banda-Bobo’s ruling read: “The application to vary bail conditions is hereby granted, and the State is directed to release the passport to enable the applicant (Banda) to travel to Tanzania from 28th June to 2nd July, 2013. The passport is to be released into the custody of Mikatazo Wakumelo, one of the sureties who shall accompany him so that he surrenders the passport immediately upon return to the State.
“The government joint investigative team (GJIT) is ordered to release the passport for a period of four days only, from 28th June to 2nd July, 2013.”
But yesterday, Mr Wakumelo, who is also administrative secretary in the Office of the Fourth President, told the media that the passport has not been released.
“We are not travelling because the passport has not been released. He was supposed to travel yesterday [Friday] but when I went to the government joint investigative team, they told me to go to the Registrar General where I was told to go to the Chief Passports Officer. There I was told to go to the Ministry of Home Affairs but the permanent secretary [Willies Manjimela] was not there in the afternoon.

If the government can ignore this law(ruling), it can ignore all laws(rulings). So whos to say that even if they lose 2016, they will follow the rule of law then? In the meantime, Foreign investors & Zambians risk has now gone up because legal outcomes cannot be determined by the rule of law but instead by the direction of government. Welcome to your Zimbabwe, where the law will only apply when the government decides its in its favor to do so. If you the people who break the law are called criminals, what does that make them. It could be said that the people of Zambia are now living in a lawless society/dictatorship. Time for democracy, rule of law, and good governance to come to Zambia. 2 Question: 1st, Why cant Zambia have good governments like in Botswana? 2nd. In Zambia, should people over the age of 55, be barred from politics?

Tondo – being in power is a privilege. Yes, MMD messed up especially in the last 2 years – they mocked the opposition so much that even for the un-partisan ZNBC became obnoxious. MMD denied coverage to PF and UPND leadership but small guys in compounds enjoyed massive media coverage as long as their message was to denounce the opposition.
Tondo, do you want PF to follow the same path? People voted PF so that such things stop.

RULE OF LAW!!!! UMmmmm. Going by this there ain’t no rule of law in Zambia. Now if there ain’t, what happens to the poor and unconnected? Ni njema chabe until you catch HIV and TB – even before you are proven guilty. Scary, ehh, are we thinking about what will happen to us when we are out of power? Crossing the bridge when we get there? There may be no bridge to cross esp if the new rulers continue from where the current ones will leave things? Suppose the so-called bitterness continues even when they get into power? It may not matter whether it is the calculator boy, the pastor, the priest or young Chipimo – they all sound bitter now. Yaaba, that will be tricky. We won’t be there forever, for sure. Maybe let us refurbish the prisons now that we are still in power – because one may go there one day -especially with the precedent we have set for ourselves in this country. Hear, those who have ears.

The gentleman has issues with the govt why allowing him out of the country when his own son is still at large over charges of corruption,to allow him to meet his corrupt lawyer Amsterdam? No we can’t allow this. Even if he can be allowed to go out of the country, what will he contribute to mother Zambia which he failed to do when he was in power? I remember towards the ened of 2011, he boasted that he loved flying around and being called Mr President now he has to wait the court vedict.

Imwe bantu, does it mean that if RB is gven a a passport he has to travel? No, it is up to immigration. When for example you acquire a visa at any local embassy, that does not guarantee you to enter that country. it will be up to the immigration officers satisfying themselves that you have met all the requirements they have set before you.
