Sexually Starved Man Seeks To Divorce Wife Over Prayer And Fasting Sessions

A 35-YEAR-OLD man told the Lusaka Boma Court that he wants to divorce his wife because she refuses to have sex with him when she is on prayer and fasting at their church.
Joshua Mahachi told senior court magistrates Lazarous Mwape and George Kaoma that the other ground to divorce his wife is that she does not respect him and because they go to different churches.
“She is an Apostolic and I am SDA. She refuses making love to me when she is doing her prayers of the week no matter how much I plead with her,” he said.
Mahachi also told the court that his wife forced him to have sex with her few weeks after undergoing male circumcision.
He said he told his wife to wait for his sores on the fore skin to heal but she thought he did not just want to have sex with her.
“She wanted me to make love to her so that we can have a child. I told her to wait for me to get healed but she thought I was doing it deliberately,” Mahachi said.
He said he had at one time slapped his wife when she refused to put his water for bathing telling him that: “You can put water for yourself. That is why you have hands.”
Mahachi said his wife had at one time refused to open the door for him when he arrived about 21:30 hours from work, as she told him to go back where he had come from.

 

He said efforts have been made by both their families, who have sat them down for more than seven times, to resolve their marital problems but to no avail.
Mahachi, in his last words, said he wanted divorce as he fears that the couple can kill each other.

 

This was heard in a matter in which, Mahachi of Chawama sued Jane Chanda, 34, for divorce. They got married in 2007 and have a child together.
In her statement, Chanda told the court that her husband wanted to leave her because he wants to marry his former lover with whom he has a child.
“He told me that he will marry his former lover from their church because I refused to stop going to my church. He allowed me to continue congregating at my church before he married me but I do not know what has changed now,” she said.
Chanda told the court that since the time she got married to her husband in 2007, she has never disrespected him.
She said her husband used to refuse to accept her apology whenever she wrongs him saying that he was not God to forgive her.
Chanda said she does not get sexually satisfied as her husband liked using condoms when making love to her.
But her husband said he was using condoms because he had not gotten healed from the wounds he had after undergoing male circumcision.
She further said she called the traditional counsellor who reconciled them on the matter but that their marital problems continued as her husband even stopped providing for his family.
Chanda said her husband had at one time packed all his belongings and he told her that he had gone to stay with his friend.
She told the court that she was shocked to find her husband having sex with another woman when she tried to prove whether he was living with his friend as alleged.
“I pleaded with him so that we can go back home despite having found him having sex with another woman but he refused. I told him that I was ready to forgive him because I knew that he has been taken by worldly things but he told me that he can marry as many women as he wants,” Chanda said.
In her submission, she pleaded with her husband to reconcile with her so that they can keep their child together.
The court granted them divorce and ordered Mahachi to compensate his wife with KR6,000 starting with an initial payment of KR1,000.
He will their after start paying KR250 and child maintenance of KR200 monthly.
The court said Mahachi has no proper reasons of divorcing his wife as he just wants to go back to his former lover.

    Why is it that courts listen too much from ladies? is it what law of natural justice tells us to do? each time they is a divorce a man is told to pay for compensation I feel it is not fair to treaty men like this.A man can be instructed to pay child maintenance which is correct.Lets look at this angle first. The two had problems and the last resort was to separate them as the two families failed and the court punishes of the man.The judgement is not fair.

    Iam an adventist myself and as such Mahachi you are disfellowshiped. 1. For marrying outside the church (a non member) 2. For cheating on your wife. 3. For going to court when you know the procedure. May your Church board deal with you accordingly.

    The Courts will never look kindly on those who break their marital obligations. Children must always be protected to defend marriage.

    This brother knew he was having an STI so by putting on a condom for sex he was actually protecting his innocent wife. Those circumsion wouds were a cover up.It was an advaned sign of an infection

    No wonder women behave fun in homes, coz they know that when it comes to court issues they are going to win the case, i blame the courts for all these happenings in homes

    Both Mahachi and Chanda are not honest bonse ba bufi. Really men are disadvantaged why compesate a woman who fight for equal rights?

    Courts a causing divorces. Married women misbehave coz they know kots always favours them.
