Man Divorces Wife For Not Bearing Him a Child

THE Lusaka Boma Court has fined a 47-year-old man of Kabangwe, KR11,000 for divorcing his wife of 21 years because she cannot bear him any children.
Johns Nyirongo told senior court magistrates Lazarous Mwape and George Kaoma that he wants to divorce his wife because he has never been happy in his marriage.
He said lack of communication with his wife is the major reason why he wanted a divorce her.
But the court castigated him for divorcing his wife because she cannot have children adding that lack of communication cannot be a ground for divorce.
“You should not forget that marriage is love and children are a blessing from God. Even if you marry another woman, you will still find a fault in her,” the court said.
This was in a case where Melvis Mwanza, 44, sued Johns Nyirongo for divorce. They got married traditionally in 1992 and have no children.
Nyirongo further said he has been telling his wife about his intention to dissolve their marriage but that he took time to act because people told him that the court favours women.
And Mwanza in her statement told the court that she got married to her husband in 1992 and that in 1993 they had a child who later died in 1994.
She said problems in their marriage started in 2012 when her husband shared their property they owned together.
Mwanza said her husband gave her a house and he got a farm saying that he did not want his relatives to trouble her when he dies because they had no children together.
She told the court that in 2013, her husband changed his behaviour towards her after she overheard him talking on his mobile phone with another woman whom he promised not to worry of anything as he will support and take care of her.
Mwanza said she told her husband if she can accompany him to his farm in Kabangwe but he refused saying she was not a woman enough.
“He told his family to inform me of his intention to marry another woman. When we sat down as both families, he clearly indicated that he is no longer interested in me,” she said.
Mwanza said they went to Chelstone Court for reconciliation but her husband refused to be reconciled.
She said her husband has stopped supporting her financially and does not buy her food
In passing judgment, the court granted the couple divorce and ordered Nyirongo to compensate his wife with KR11,000 starting with the initial payment of KR1,000 followed by KR500.

    This issue will not be the last of its kind. In African custom, a wife must be able to bear children. But what the Court has said here is quite radical. As a result the case is being made for children to be had by adoption. I wonder what all this means for Zambia and its traditions of family and marriage.

    KR 11,000 has the kwacha been rebased again, we stoped using KR on 30 june 2013 please move with change and time.

    Well, it is very sad that after having one child that passed on the lady couldn’t conceive again and it is sadder that now she is divorced. Did she try hard enough to get help from gynecologists at UTH? It is imperative to understand how a woman who once was able to give birth could not produce any children afterwards.
    Could it be that the woman never just wanted to have children or developed some complications? These are the facts this couple was not ready to delve into during the divorce hearing.

    Maybe the chap is the one with the problem. The child who died was probably not his. This world is tricky.

    we been married with my wife for fourteen years now.my wife has had six an xplained miscariages.after 11 years we had twins who were accidentaly given the wrong injections when they were born and passed on after a week.
    last year my wife gave birth to twins again and we jus celebrated their first birthday! am happy i never left her side during the hard times we had.

    Ba Tumfweko How is this possible. you started by saying a 47 year old man of kabangwe is divorcing his wife of 21 years and then you go ahead to say the wife is 21 years but they got married in 1992. Further you say this was in a case where Melvis Mwanza 44 sued Johns Nyirongo for divorce. Whats going on ????????????????????????????????????????

    measure of last resort.for better for worse.im very sure that they both knew that they could not have children.Why coming out in public like this?learn to settle such issues outside court.they both need counseling.

    leaving her coz of no children is not a solution be brave enough and stand by your wife we say nangu chipuba chipuba chandi you will get one who will lie to u that they are ur children when not just to keep u around think again u will miss ur wife foolish man
