A 34-YEAR-OLD woman of Ndeke in Kitwe has been sentenced to one year simple imprisonment for assaulting her husband’s lover.
Kitwe senior resident magistrate Daniel Musonda, however, suspended the sentence slapped on Catherine Mulenga for two years provided that she does not commit a similar offence within that period.
This is in a case in which Mulenga was charged with assault occasioning actual bodily harm.
The offence is contrary to Section 248 of the Penal Code Chapter 87 of the Laws of Zambia.
Particulars of the offence were that Mulenga on February 24, 2013 in Kitwe, did assault Bridget Ching’anda.
Mulenga denied the charge.
Delivering judgement yesterday, Mr Musonda said he is satisfied that the State has proved the case against Mulenga beyond reasonable doubt.
“I have taken note of your situation and you deserve the leniency of the court but next time when you hear that your husband is misbehaving, don’t take the law into your own hands… if you notice that your husband is neglecting his duties or failing to provide for his family, you should take him to court,” Mr Musonda said.
In mitigation, Mulenga said she takes care of her four children and that her husband has left their matrimonial home and is cohabiting with Ms Ching’anda.
Mulenga said her children will suffer if she is sent to prison.
During trial, Ms Ching’anda told the court that she was in her house on the fateful night when she heard a loud knock on the door.
Ms Ching’anda told the court that when she opened the door, she found Mulenga, who told her that she was looking for her husband.
She testified that she told Mulenga to enter the house and look for her husband.
Ms Ching’anda said Mulenga then reached for a bottle and used it to assault her.
In defence, Mulenga said she went to look for her husband at Ms Ching’anda’s house but she did not enter the house because he had allegedly already sneaked out through the kitchen door.

They should introduce a law which should punish amaule as well as long as a pro is found wit ones husband must be punished vikwati bantu vasila chifukwa cha mahule and at the end of it all abana balechulilamo. Thoses street kids we seeing are there not becoz they hav no parents but bcoz of divorce due to selfishness of man. Mwemahule muli banakashi naimwe. Mukafisanga one day. Mayo namulenga shipa. Kakolwe, it will take another 50 years for The Zambian women to reach that level of sophistication.
Zambian women love back stabbing each other such that they would kick each others butts while hubby to one of them walks off clean.
The most important aspect is for every woman to ensure that they are empowered and self reliant.

@Mundia M very true Zambian women its like they have no vision except getting married and depending on their husbands that’s why they go out fighting for a man who is cheating on them because marriage is like a means of survival for them. I mean really why would a man who loves and respects you go after another woman a man who knows very well that he is married.

Alicita bwino ukucinyela iciliule ico. What type of law is that? The poor woman acted out of frustration. It is not all the women who have the means of empowerment or educated. It is only a few of us who have walked out of our marriages and have moved on because we are able to be in formal employment. Business ala yalikosa.

Basic law should be enacted.
If a married person strays, the spouse should be automatically guaranteed a divorce and children they can prove through dna are theirs.
Further, all property except a pot, pan and single bed should be handed to the innocent spouse.
Salary must be garnished from source for 10 years or till kids are 18 years old.
All landed property should be auto transferred to innocent spouse including 51% share holding of any businesses.
All pricks will stay home!
