Castle Lager Lands Livingstone Student in Prison

A 22-YEAR-OLD accountancy student at Livingstone Institute of Business and Engineering Studies (LIBES) has told the Livingstone Magistrate’s Court that he assaulted a man because he was intoxicated with Castle Lager. Jolly Chibawe, of house number 46, Nheru Wa y, Livingstone, appeared before magistrate Edsen Shanduba on Wednesday and pleaded guilty to assault. The offence is contrary to section 248 of the Penal Code Chapter 87 of the Laws of Zambia. Particulars of the offence are that on April 27, 2013, Chibawe assaulted Abraham Kazoka and injured him. When asked why he beat Kazoka, Chibawe blamed Castle Lager for his violent behaviour. Facts read before the court are that on April 27, 2013, around 20:00 hours, Chibawe was at East Point nightclub having a drink with others. Kazoka’s wallet, which contained K210, went missing and he suspected that Chibawe could have stolen it. Asked whether he could have seen it, Chibawe declined but when he was searched, the wallet was found on him and the K210 was missing. Kazoka demanded his money from Chibawe but he refused and punched him (Kazoka) in the face and he suffered a swollen eye. The matter was reported to Livingstone Central Police and Chibawe was apprehended. He was arrested and charged with assault. Asked whether the facts were correct, Chibawe replied in the affirmative, but denied stealing the wallet. In mitigation, the student asked the court to be lenient with him because he needed to complete his tertiary education. But magistrate Shanduba wondered why Chibawe chose to spend his time and energy on alcohol at the expense of his studies. “Students are supposed to spend their time researching but you chose to drink. “I am sorry you have yourself or the Castle to blame…12 months in prison from the time of arrest on July 9, 2013. “You will continue with your school and your Castle after 12 months,” the magistrate said.

    Its a bit harsh to send a student to prison for 12month esp that his wallet was stolen and found on the man he punched.why not give him a suspended sentence and fine him.in jail he will jus become a criminal instead of a contributing tax paying citizen he would have been

      The story says the same chap (Student) stole the wallet and used the money not the way u have put it bwana. Good for the chap to serve a 12months term infact as he has proved to be Esther Phiri wanna be and Pompwe.

      It is the student who was found with the wallet and not the other way.

    why this judgment on the student? something is wrong with the magistrate for real. the student punched the man coz he store his wallet and money but in the end its the student who goes behind the bars.

    He is a thief. Hw can he punch the owner of the wallet he stole. Two charges stealing ad assault.He deserves the jail term.

    Hahahaha,,,Intoxication is not defense by the law any where in zambia, you do things under the influence alcohol and you expect lenience to be on.
