It was Defence, Not Assault, Says Woman

A WOMAN of Chipulukusu in Ndola, who is charged with assault, has told the Ndola Magistrates’ Court that she acted in self defence when she assaulted her neighbour, who allegedly attempted to rape her.
This is in the case of Mary Bwanga, 34, a housewife of house number 348, Chipulukusu.
The offence of assault is contrary to Section 248 of the Penal Code Chapter 87 of the Laws of Zambia.
Particulars of the offence are that Bwanga on February 28, 2013 in Ndola, assaulted Sumani Banda and occasioned him actual bodily harm.
When the matter came up for plea before Ndola magistrate Joan Tamba on Monday, Bwanga told the court that Mr Banda fell and got hurt after she pushed him when he attempted to rape her.
“Your honour, I did not assault him. I pushed him because he wanted to have sex with me by force as I was washing clothes in my yard. I did so in self defence your honour,” Bwanga said.
Ms Tamba entered a plea of not guilty and adjourned the case to September 12, 2103 for commencement of trial.

all the best Mr Banda, everything is against you. How do find yourself in ur neighbours’ premises. I am not convinced you can attempt rape in broad day light and in the ‘yard’ – meaning outside. All the best

Sure She was defending herself, let her go. She is a free woman. If the Court Will Charge That woman, it means the Court is supporting such barbaric acts in our country.
