THE Kitwe High Court has put a 33-year-old teacher of Nakatindi Basic School in Chingola on his defence after finding him with a case to answer in a case of murder.
Edgar Chinyanta, of house number 1010 Nile Crescent, Riverside, Chingola, is charged with murder, contrary to Section 200 of the Penal Code Chapter 87 of the Laws of Zambia.
It is alleged that Chinyanta, on March 22, 2013 in Chingola, murdered Derrick Musenge.
In her ruling on Friday, Mrs Justice Judy Mulongoti said after considering the evidence of the prosecution, her view was that Chinyanta was connected to the murder.
Mrs Justice Mulongoti said the State had managed to establish a prima facie case of murder against Chinyanta, which required him to be on his defence.
Earlier, detective sergeant Peter Chushi of Chiwempala police station told the court that on March 22 ,2013, he was allocated a docket of murder to investigate in which Harrison Chinunka reported that his 19-year -old nephew, Derrick Musenge, had been killed by an unknown person.
Mr Chushi said he followed up the matter and on March 26, 2013 Chinyanta was apprehended in connection with Mr Musenge’s death.
Mr Chushi said Chinyanta’s brother gave him (Mr Chushi) a knife which Chinyanta had allegedly used to murder Mr Musenge.
But under cross-examination by Chinyanta’s lawyer, Mapenzi Hamachila, Mr Chushi said he did not find any blood on the knife suspected to be the murder weapon.
He also told the court that he was not aware that Chinyanta worked for the military on a part-time basis.
Mr Chushi said he was not aware that Chinyanta had a full military uniform, a pair of boots and a knife which was given to him by the army.
Mrs Justice Mulongoti adjourned the case for continued defence.
And the Ndola magistrate’s court has slapped a K3, 000 fine on a 38-year-old Somali businessman for unlawful entry and stay in the country, MUBANGA NONDO reports.
This is in a case in which Omar Jama was charged with two counts of unlawful entry and stay in Zambia.
Ndola magistrate Joan Tamba said she would impose a harsh sentence on Jama to deter would-be offenders because she had noticed an influx of people entering the country without authority.
In the first count, Jama is charged with unlawful entry into Zambia, which is contrary to Section 12 (2) as read with Section 56(1) of the Immigration and Deportation Act number 18 of 2010 of the Laws of Zambia.
In the second count, Jama is charged with unlawful stay in Zambia.
The offence is contrary to Section 11(3) as read with Section 56(1) of the Immigration and Deportation Act number 18 of 2011 of the Laws of Zambia.

Too bad, teachers ar blessed coz even Jesus was called teacher. Muder is not only against zambian law but is also a bibilical ofence.
