Court Orders Lusaka Man ‘Pay For Virginity Damage’
THE Lusaka Boma Court has ordered a 33-year-old man of Chawama Township to pay K3,000 as compensation for virginity damage resulting into pregnancy.
Senior Court magistrate Morgan Kayanika ordered Isaac Ngulube to pay Kale Mwana, 43, of the same township for virginity damage.
This was in a case in which, Mwana sued Ngulube for compensation for virginity damage.
Ngulube and Mwana’s daughter Betty Mbeye have a five-month-old baby together.
Mwana told the court that he did not have the details of the pregnancy except he wanted the court to ensure Ngulube paid him for breaking his daughter’s virginity.
But in his statement, Ngulube told the court that he had never refused being the baby’s father. He said he was the one who has been providing for the baby and its mother since the baby was born.
Ngulube told the court he had been in a relationship with Betty since April, 2012 and that she conceived in June the same year. He said he was summoned to meet the girl’s parents after they discovered she was pregnant.
“The girl was brought to my house and only returned to her parents when she was due. I provided everything for her and the baby.
As per their tradition, I was ordered to buy 20 litres of cooking, 50kg sugar as well as Chitenge materials with matching shoes and a handbag,” he said.
He said her father was in charge of the monetary part but that he was unable to discuss the issue with him because he was drunk at the time.
Ngulube said he had not refused to pay, adding that the only problem that delayed him was his mother’s illness. Passing judgment, the court ordered Ngulube to pay K3,000 as compensation with an initial payment of K500 August monthend to be
followed by monthly instalments of K200.
Ngulube was also ordered to maintain to child by ensuring he provided everything the child needed.

Indeed u are right. What claiteria did the court use to prove that this woman’s virginity was broken by this man at that age and that she is pregnant??? Uyu umwame ba mushingilefye amala ya mbushi. UNLESS THEY TELL ME THAT COURTS OR ZAMBIA HAVE STARTED MANUFACTURING VIRGINOMITORS TO PROVE A WOMAN’S VIRGINITY. Because for me word of mouth at her age 43 years, is NOT proof enough!!!!!!

I read the story in the sunday mail 25th august 2013, particulars are that Ngulube(man) and Mwansa(woman) have a 5 month old child together but relatives of Mwansa are now seekin damages. Ngulube has never refused that the child is his but the family still want him to pay.
Ngulube said he always supported mother and child while pregnant and after the child was born his mother become sick and had to take care of her and thus why he failed his fatherly responsibilities resulting to this court case.
