Prof. Clive Chirwa Sues Govt Over His Passport
PROFESSOR CLIVE Chirwa has petitioned the Attorney General and the Anti-Corruption Commission in the Lusaka High Court, demanding the release of his passport.
According to an affidavit filed in the Lusaka High Court on September 4 by Professor Chirwa’s lawyers, Simeza, Sangwa Associates, the petitioner is demanding the release of his passport to enable him to travel to the United Kingdom to see his ailing wife.

Particulars of the matter are that Prof Chirwa, who served as chief executive officer of Zambia Railways Limited from November 7 last year to June 7 this year, had his passport withheld by ACC while being investigated for alleged corruption during the months he had served at the helm of the railway company.
Chirwa has petitioned the Attorney General and ACC as the first and second respondents respectively.
ACC had instituted investigations into the operations of the Zambia Railways around April and May until July this year.
The investigation team seized Prof Chirwa’s passport, number ZN013911 on May 2, to confine him within the country until he is cleared of alleged mismanagement of the rail company.
“The petitioner will say that his wife, who is a resident in the United Kingdom, has been diagnosed with cancer and is receiving treatment in the United Kingdom and the petitioner is required to travel to attend to his ailing wife and to sign some vital documentation as next of kin with the hospital treating her,” reads the petition in part. “The Petitioner’s right to freedom of movement outside Zambia guaranteed by Article 22 of the Constitution has been and continues to be violated against him in that he has been denied the right to travel outside Zambia. That it may be determined and declared that the seizure and continued detention of the petitioner’s passport is a violation of Article 11(b) and 22 of the Constitution of Zambia.
“The investigative team from the Anti-Corruption Commission took away my passport during the period when they were collecting data and I being interviewed. The same team has now informed me to write to the director general for the return of my passport. I therefore herewith ask permission for my above passport number ZN 013991 to be returned to me so that I can travel to see my family.”
In the petition, Prof Chirwa’s residential address is house number 16 Coed Pela Road, Colwyn Bay, L297BA, United Kingdom and availed correspondence between him and his son Daniel concerning his sick wife.

This is unnecessary persecution of Prof Chirwa. Didn’t investigations clear him of wrong doings and government officials issue statements that he was being retired on national interests with gratuity? Such conflicting view points from the authorities!! That said, regardless of the status of his case he should be allowed to travel to tend to his wife an family affairs. I shudder to think that he has been confined to Zambia the last few months and not able to visit them because of the investigations….which we all thought had be concluded and him found not guilty!!! tat tat tat

I now believe kuti all that glitters is not gold. Chirwa s vision for ZRl looked marvelous (Coupled with his 30 page CV).I even sent my 2 page CV to ZRL. Shame!
