Luanshya Man Jailed 25 yrs For Sodomy
A NDOLA High Court has sent a 32-year-old man of Luanshya to prison with had labour for 25 years for sodomising a five-year-old boy.
High court Judge Petronella Ngulube jailed Chilufya Mulenga, a garden boy of 25 Kambilombilo Township who was convicted by Luanshya magistrate Edward Banda upon his own admission of guilt to the charge.
The convict on July 4, had carnal knowledge of a boy below the age of 16 against the order of nature contrary to the Laws of Zambia.
Facts were that the now convict on July 4, this year, was employed to carry out part-time work at the boy’s father’s house.
The father of the boy left Mulenga at his house working with the boy and four other children.
“The convict got hold of the five-year-old boy and had carnal knowledge of him against the order of nature and promised to give him biscuits.
“The boy reported him to his father after Mulenga failed to fulfill his promise behind the act,” read the facts.
In mitigation, Mulenga pleaded for lenience through Legal Aid council Kateule Chitupila.
Ms Chitupila pleaded that her client was a first offender who readily admitted to the charge and that he was married with two children.
She pleaded that Mulenga was remorseful and that he reflected it during his period of incarceration.
When passing sentence, Ms Justice Ngulube took into account his mitigation and that he was a first offender who admitted to the charge.
However, she told the convict that his action was unacceptable and evil to society as he had promised the boy to give him biscuits before having carnal knowledge against the order of nature.
She then sentenced him to 25 years with hard labour effective from July 5, the date of his arrest.
