‘I Caught Her Having Sex With My Husband’

HOUSEWIFE of Racecourse in Kitwe has told the Kitwe Magistrate’s Court that she assaulted her husband’s lover because she allegedly caught her having sex with her spouse.
This is in a case in which Petronella Mutale, 28, of house number 2514, Racecourse, is charged with assaulting Brenda Musonda and occasioned her actual bodily harm.
The offence is contrary to section 248 of the Penal Code Chapter 87 of the Laws of Zambia.
Particulars of the offence are that Mutale on September 20, 2013, assaulted Ms Musonda.
When the matter came up for plea before Magistrate Kampinda Chipamu on Tuesday, Mutale admitted the charge.
“I beat her up because I caught her red handed having sex with my husband and she is the reason why my Grade nine daughter is not sitting for her exams because my husband has been giving all the money to her.” Ms Mutale said.
But Ms Chipamu entered a plea of not guilty because of Mutale’s explanation.
Evidence before the court is that on the material date around 19:00 hours, Ms Musonda was on her way to get money from her friend when she met Mutale.
Ms Musonda testified that Mutale beat her up and called her a prostitute.
She narrated that an instant justice mob also descended on her, stripped her naked and she bled profusely.
Ms Musonda testified that she reported the matter to police and Mutale was arrested and charged for assault.
Ms Chipamu adjourned the case to October 16, 2013 for ruling.
