Kitwe Man Sentenced 30 Years For Defiling Stepdaughter

KITWE High Court judge Catherine Makungu has sentenced a 30-year-old man of Chililabombwe to 30 years imprisonment with hard labour for defiling his seven-year-old stepdaughter and infecting her with syphilis.
Mrs Justice Makungu yesterday upheld the conviction of Alex Chabala by the subordinate court for defilement and imposed a 30-year jail term on him.
Particulars of the offence are that Chabala on dates unknown but between January and April 2013 in Chililabombwe, had unlawful carnal knowledge of a girl under the age of 16.
Passing the sentence, Mrs Justice Makungu said there are aggravating circumstances in the case.
“The child you defiled was your own stepdaughter only aged seven and you infected her with syphilis. I, therefore, sentence you to 30 years imprisonment with hard labour with effect from the date of your arrest,” Mrs Justice Makungu said.
In mitigation through his lawyer Sekelebako Kundachola, Chabala said he is remorseful for his actions and asked the court to be lenient on him.
During trial, the girl’s mother testified that on April 29, 2013, she discovered sores on her daughter’s private parts while bathing her.
She testified that she took her daughter for medical examination and that the doctor confirmed that she had syphilis.
She said the girl revealed to her that Chabala had been having sex with her.
And the girl testified that Chabala had sex with her while her mother was away in the bush.
She testified that she did not tell anyone that Chabala had sex with her because she was afraid.
And in another case before the same court, a 61-year-old man of Racecourse in Kitwe has been sentenced to 15 years imprisonment with hard labour for defiling a 13-year-old girl.
Mrs Justice Makungu yesterday upheld the conviction of Jordan Chikosa by the Kitwe Magistrate’s Court.
Particulars of the offence are that Chikosa on May 4, 2013 in Kitwe, had unlawful carnal knowledge of a girl under the age of 16.
In mitigation, Chikosa said he looks after his orphaned grandchildren and that his health is poor.
Mrs Justice Makungu said she had considered Chikosa’s mitigation and imposed a 15-year jail sentence on him which is the minimum sentence for defilement as prescribed by the law.
