Mulusa, Changala Apply for Establishment of Tribunal To Probe Kabimba

Former Solwezi Central Member of Parliament Lucky Mulusa and Civil Rights Activist Bredner Changala have filed in an application to the Acting Chief Justice for the establishment of a tribunal to probe alleged abuse of office by Justice Minister Wynter Kabimba.

The application which is dated December 24, 2013 has the terms of reference to investigate whether Mr. Kabimba did abuse his office or not when he allegedly used a government legal opinion offered to him in his capacity as Minister of Justice by the Solicitor General Musa Mwenya to allegedly pursue a private agenda of the ruling Patriotic Front (PF) and subsequently by a private litigant.

Mr. Mulusa has disclosed to Qfm in an interview that other matters of the terms of reference the applied for tribunal is to investigate whether or not Mr. Kabimba is his capacity as Justice Minister breached his oath of secrecy when he released a clarified government legal opinion for use by the ruling PF and subsequently an individual litigant Mr. Leonard Banda.

Mr. Mulusa also notes that he and Mr. Changala are seeking that the tribunal also investigates whether or not the letter copied to the Acting Chief Justice Lombe Chibesakunda that had a PF letter head attached with a legal opinion from the Solicitor General constituted an act of interference to independence of the Judiciary as guaranteed by the country’s constitution.

He adds that he and Mr. Changala further want that the tribunal recommends to the government the appropriate action to be taken on the findings of its investigations.

He says in view of the application for the establishment of the said tribunal, he and Mr. Changala intends to supremor the Solicitor General Musa Mwenya, acting Chief Justice Lome Chibesakunda, the Attorney General Mumba Malila, Electoral Commission of Zambia (ECZ) chairperson Justice Irene Mambilima, Judiciary Deputy Registrar Ms. Chilombo Phiri and Master of the Supreme Mr. Yorum Mwale .

Mr. Mulusa adds that others are Lawyer Bonaventure Mutale, Judiciary public relations officer Terry Musonda, losing Petauke Central Member of Parliament (MP) Leonard Banda, MMD president Nevers Mumba and Daily Nation newspaper proprietor Richard Sakala.

    Winter kabimba is untouchable. Before you set up a tribunal inform the president so that you are given a go ahead as per instruction.This man has destroyed PF govt. MCS will regret when its too late. GBM was a genuine supporter of Sata but not Winter k. Ba Sata shibukeni
