Kitwe High Court Acquits Woman Charged With Murder of Hubby

THE Kitwe High Court has acquitted a 48-year-old woman of Kasama indicted with murdering her husband at Sweet Corner Guest House in Kitwe.
This is in a case in which Regina Kabuswe was facing one count of murder, which is contrary to Section 200 of the Penal Code Cap 87 of the Laws of Zambia.
It was alleged that Kabuswe, on May 10, last year, in Kitwe murdered Ronald Mwamba.
She denied the charge.
When the matter came up for ruling on Monday, High Court judge-in-charge Catherine Makungu said the state had failed to establish a prima facie case of murder against Kabuswe.
“I have carefully considered the evidence on record and it appears that the accused person is being prosecuted for the murder of Ronald Mwamba just because of suspicion,”Mrs Justice Makungu said.
She said the circumstances which appear to have prompted Kabuswe’s prosecution are that she was staying in the same room with Mr Mwamba.
Mrs Justice Makungu said on the material day, Kabuswe left the room in the morning, bought a beer from the bar at the Guest House, took it behind the rooms, and washed her hands at a tap.
“She was later found holding the deceased’s bag in the room while he was fitting and she failed to answer questions as to what led to that,” Mrs Justice Makungu said.
She said there is no evidence suggesting that Kabuswe had a motive to kill Mr Mwamba.
She said it was doubtful if Kabuswe actually poisoned Mr Mwamba with the poison found in a container in a pillow cover at the Guest House because there is no evidence that her finger prints were on the container.
“It is possible that the deceased had committed suicide by poisoning himself. Given this scenario, no reasonable tribunal would convict the accused person if she was put on her defence and opted to remain silent.”
“The prosecution’s evidence is very weak. I find the accused person with no case to answer and I acquit her,” Mrs Justice Makungu said

    but how did that container find itself in the room and what was the reason for her washing her hands and that was after buying a beer and taking it behind the rooms WHERE AND WHO DID SHE GIVE THE BEER TO, and somebody is fitting and you are busy holding his bag instead of asking for help…..judgement has been passed but is it cr…ble?

      This judge is incompetent and corrupt, among the female judges she is most corrupt.

    Neva put ur confidence on earthly juditiary cz anything can be termed as fair judgement.
    Howeva, forgive them for all the wrongs they may be doing wen executing their duties.

    Not fair judgement. Men should preside over such cases not folks with boobs.

    Something same where is not right here

    1.Why wash her hands out side the room does it mean the room hard no water ?
    2.Why hold the bag of a man who’s in a critical condition instead of calling for help ?
    3.Why did she have to take the beer behind the rooms what was she hiding ?

    That’s why never ever trust a woman and especially the Judge is also a woman tefintu manee.

    Even if it was just on suspicion it is indeed suspicious. I wish we could hear the woman’s story also. God knows exactly what happened and he will judge when the time comes.

    This female magistrate knows very well that she has passed a very unfair judgement! She will bear the guiltiness till she goes to hell! Relatives appeal! U will win this case without a doubt!

    The story of fishy. If the family of late want to know the truth, they should appeal this case and let a professional judge analyse it.

    Guys you should blame the prosecutors. The judge is there just to give vedict after the prosecution and the defence has given there aguments. The prosecutors we have are very dull. The judge cant think for them
