THE Livingstone Magistrate’s Court has convict a Congolese national of unlawfully staying in Zambia for 13 years.
Magistrate Chinkashi Chilingala on Tuesday convicted Joseph Shimanga, 32, of house number F 45, Malota compound in Livingstone, for unlawfully staying in Zambia
This is in a case in which Shimanga is charged with unlawful stay in Zambia which is contrary to Sections 11 (3) and 52 (1) as read together with Section 56 (1) of the Immigration and Deportation Act number 18 of 2010.
Shimanga admitted the charge and told the court that he has been living in Zambia since 2000 without a permit.
“I have been in Zambia since 2000, I had no papers to allow me to stay in the country,” Shimanga said.
Particulars of the offence are that Shimanga, on dates unknown and being a Congolese national, remained in Zambia without authority.
Facts before the court are that immigration officers apprehended Shimanga after members of the public complained that there were many foreigners trading at Maramba market.
In mitigation, Shimanga pleaded with the court to be lenient with him because his family will suffer if he is sent to prison.
Mr Chilingala reserved sentencing.
