21-Yr Old Jailed For Stealing TV

THE Lusaka Magistrate’s Court has slapped a one-year jail sentence on a 21-year-old man of Jack township for breaking into a house and stealing a flat-screen television set worth K2, 200.
Magistrate Mwaka Mikalile on Friday jailed Davison Banda after he pleaded guilty to burglary and theft which is contrary to Sections 303 and 272 of the Penal Code Chapter 87 of the Laws of Zambia.
Particulars of the offence are that Banda on January 23, this year in Lusaka, broke into Caroline Magwaza’s house and stole a television set.
Passing the sentence, Ms Mikalile rejected Banda’s mitigation that he committed the crime because he is unemployed.
Ms Mikalile said unemployment is not an excuse to steal other people’s property and letting Banda go scotfree would be a betrayal to justice because he is not physically handicapped.
“Upon your own admission I find you guilty, I will exercise leniency because you readily admitted the charge and you did not waste the court’s time. You are young and you must always strive to earn an honest living. I sentence you to 12 months imprisonment with hard labour,” Ms Mikalile said.
In mitigation, Banda said he stole the television because of poverty and unemployment.
“I stole the television because of suffering I do not work, however what I did was wrong. I ask you, your honour to have pity as I did not waste your time by readily admitting the charge,” Banda said.

    I find this action by the court rather unfair and ridiculous. It’s ironic that the marijuana farmer caught with tonnes of cultivated weed could be set free and just fined while a poor 21yr old gets slapped a year in jail with hard labor for stealing a flat screen TV, and this is after the man had admitted to stealing the said item. Kangaroo court system….wako ni wako….
