Two 19-year-old Grade nine pupils of Chibolele Basic School in Ndola’s Chipulukusu stunned Ndola chief resident magistrate Paul Chisha when they told him that the marijuana which Drug Enforcement Commission (DEC) officers found in their possession was not for smoking but for treating an ear infection commonly known as “Infuko” in Bemba.
This is in a case in which Collins Ngosa, of house number KB 19 and Steven Chewe of house number KB9 are charged with trafficking in a psychotropic substance.
Particulars of the offence are that Ngosa and Chewe on March 17 this year in Ndola, jointly trafficked in 2.1 grammes of marijuana, a herbal product of cannabis sativa without lawful authority.
When the matter came up for plea last Thursday, Ngosa told the court that his sister-in-law only identified as bana Ruth (Ruth’s mother) sent him to buy marijuana because she wanted to use it to treat her daughter’s ear infection.
Ngosa caused laughter in court when he kept on referring to marijuana as “Dobo”.
“We did not intend to smoke the ‘Dobo’ that we were caught with. We were sent to buy the drug by my sister-in-law so that she could use it on her daughter who has been suffering from an ear infection,” Ngosa said.
When asked by Mr Chisha what he and Chewe wanted to do with the marijuana, Ngosa responded that Chewe only escorted him to buy the illicit drug because he is his friend and tribal cousin.
But Mr Chisha wondered whether marijuana is medicine for ear infections and ordered that Ruth’s mother be brought to court so that she could confirm that she sent Ngosa and Chewe to buy marijuana.
Mr Chisha also ordered that Ruth’s mother should prove that marijuana is a scientifically proven cure for ear infections.
“You see, telling a lie is not good, because I will summon Ruth’s mother to come to court and testify whether she indeed sent you to buy marijuana to use as medicine.
“And I am further instructing the Drug Enforcement Commission (DEC) to ensure that Bana Ruth comes to court and tell the court how ‘Dobo’ is scientifically proven to be medicine for ‘Imfuko’,” Mr Chisha said.
He adjourned the case to today for facts.

Am surprised that the Magistrate does not know the herbal medicinal value of Dobo to treat an ear infection. Some of us have seen and proven that Dobo works.

The judge should lead the way by proving that all the herbal medicines used in Zambia are scientifically proven.

Surely, asking bana Ruth to come and explain to the court whether it is scientifically proven that marijuana heals ear infection is nt fair. Can the court itself explain how panadol is scientifically proven to heal headache wen they buy panadol for headache. It is according to what we are made to believe. We take medicines not because we can explain the scienitific proof but by faith from those that claim it cures….simple. BanaRuth is not in a position to exlpain scientific concepts.
