DRC Man in Trouble For illegal Staying In Zambia For 28years

THE Ndola Magistrate’s Court has slapped a nine-month sentence on a 54-year-old man from the Democratic Republic of Congo (DRC) for illegally staying in Zambia for 28 years.

Magistrate Misozi Banda last Thursday found Shadreck Kafula guilty of illegal stay in Zambia and convicted him.
“I find the prosecution has proved their case beyond reasonable doubt and I convict you accordingly,” Ms Banda said.
It was alleged that Kafula, on unknown dates but between January 1, 2006 and May 15 this year in Ndola,  did remain in the country without authority.
During trial, immigration officer Lillian Chembe told the court that Kafula was apprehended in Kabushi township after he failed to produce identity documents.
Ms Chembe said Kafula was taken to Immigration offices for interviews and claimed to be a citizen born of a Zambian mother and a Congolese father who had stayed in the Democratic Republic of Congo (DRC) for a long time.
“He failed to prove that he was Zambian and he was arrested and charged with the subject offence,” Ms Chembe said.
He also claimed that he has a brother who works for Ndola Lime but failed to prove it.
In defence, Kafula said he was born in Zambia but went to DRC to join his father and he returned to Zambia in 1986.
“I did not collect any documents at the consulate as it was expensive and I did not have time to get the green national registration card as I was busy playing football,” he said.
In mitigation, Kafula said he is married to a Zambian woman with whom he has 10 children and nine grandchildren.
He said he has stayed in Zambia for a long time and he would like to remain in the country.
Delivering judgment, Ms Banda said Kafula had no proof that he was a Zambian citizen.
“Unlawful stay in the country for 28 years is a deliberate move as you would have legalised your stay by now,” Ms Banda said.

      Of course he’s guilty but so is our porous immigration system! Am sure this man has been visiting DRC regularly while living in Zed. What was his immigration travel record showing on our Home Affairs computers?….. UBUFI !!!!!!

      I entirely agree, he should be naturalized! If he is deported it will be especially bad for the large family he will leave behind.

    How can a person leave his 10 children in zambia and de grandchildren,he was suppose to be punished and legalise his stay in zambia.

    Imwe naimwe, how many zambians are living in other countries even without proper papers? just leave him alone bututu fye ubo mulecita. JUST LEAVE THE GUY ALONE HE HAS CHILDREN TO TAKE CARE .

    If it was a Zambian who committed such an offence in DR Congo,stiffer punishment would have been the order of the day. 9 months sentence????

    How many Rwandis are in chibolya and the surrounding area?This man has stayed in Zambia more than Ten yrs,He is old already,if that is how it is,then the immigration should be given the recruits so as to clean up lsk city of these guys and measures should be put in place to make sure that these people they never come back in Zambia again.
