A 25-year-old man of Chipulukusu township in Ndola has been sentenced to two years imprisonment with hard labour by the Ndola Magistrate’s Court for obtaining K16, 500 by false pretences.
Magistrate Moffat Phiri last Thursday jailed Jonas Zimba, 25, of house number 2234, after he pleaded guilty to obtaining money by false pretences.
Passing the sentence, Mr Phiri advised Zimba against resorting to crooked ways to progress in life.
“What you did was very bad. You do not need to be a crook to earn a living or to progress in life. I would suggest that you return part of the money that you obtained from the complainants so that we give it to them if you have any amount remaining.
He said Zulu will serve a one-year sentence if he looks for the money to return to the complainants.
“You should also advise your colleagues as they come to visit you in prison that they should desist from this habit of conning people because if they continue doing so, they also end up like you,” Mr Phiri said.
He granted Zimba leave to appeal to the High Court within 14 days.
In response, Zimba told the court that he had used up all the money on his medical expenses because he suffers from a chronic neck disease.
In the first count, Zimba on July 11 this year in Ndola with intent to defraud, obtained K6, 000 cash from Benson Samboko by falsely pretending that he had land for sale.
In the second count, Zimba obtained K10, 500 cash from Oscar Mambwe on a pretext that he had a piece of land for sale when in fact not.
Facts before are that on February 19 this year, Mr Mambwe went to look for a piece of land to buy when he met Zimba who informed him that he had land for sale in Minsundu.
Mr Mambwe and Zimba went and viewed the piece of land and he immediately paid K10, 500 for it. .
The court heard that on February 25, Mr Mambwe went to the piece of land and started clearing it when some people told him not to tamper with their land.
Mr Mambwe tried to contact Zimba but his phone was switched off.
He decided to report the matter to Chifubu Police Station.
In the second count, Mr Samboko was also looking for land to buy when he got information that Zimba had land for sale in Minsundu area.
Mr Samboko met Zimba and viewed the land before paying him K6, 000.
The court heard that Mr Zimba immediately started developing the land but some people stopped him and told him that the plot was theirs.
Mr Samboko went to look for Zimba and apprehended him.
He took Zimba to Chifubu Police Station where he was arrested and charged with obtaining money by false pretences.
