For Prison Break, Ndola Man Jailed 6 Months

THE Ndola Magistrate’s Court has sentenced a 28-year-old convict to six months simple imprisonment for escaping from Kansenshi State Prison.
Magistrate Misozi Banda last Friday convicted Sydney Mwansa after finding him guilty of escaping from lawful custody.

Mwansa was serving a sentence for theft of motor vehicle when he escaped.
Delivering judgment, Ms Banda said there was no doubt that Mwansa was in lawful custody when he escaped.
“Having considered the evidence in this matter, I have no doubt that the prosecution has proved all the ingredients of the offence. I, therefore, find the accused person guilty of the offence and I convict him accordingly.
“I note that the accused is serving for other offences but as regards escaping from lawful custody, he is a first offender. I sentence you to six months simple imprisonment with effect from the date of arrest. The sentence will run after any other sentences running,” Ms Banda said.
Mwansa, on May 25 this year in Ndola, being under the lawful custody of sergeant Chilonga, a police officer, did escape from such custody.
Evidence before the court is that Mwansa was detained at Kansenshi State Prison.
The court heard that one morning, Mwansa requested to use his phone to inform his relatives about his predicament.
The officer on duty checked in the register for items for detainees and found that Mwansa had no phone on him but he insisted that he had one.
The court heard that Mwansa was removed from his jail cell to check for his phone and the warder later decided to take him back to the cell when he did not find it.
The court heard that while the police officer was opening the lock to the cells, Mwansa bolted.
