Ndola Chickens Thief Jailed 3 Years

A 31-YEAR-OLD man of Kawama Township in Ndola has been sentenced to three years imprisonment with hard labour by the Ndola magistrate’s court for attempting to steal chickens from a chicken run at a house in Kansenji State Prisons camp.
Magistrate Eston Kafunyi on Monday convicted Prosper Kabaso, unemployed, of house number 2724 in Kawama after he pleaded guilty to a charge of breaking into a building.

Passing sentence, Mr Kafunyi said that although Kabaso did not steal anything from the chicken run, the hole he made in the wall of the chicken run portrayed him a thief.
“I have noted that there are a lot of break-ins in this town and that people are losing property in the process. Although you did not steal anything from the chicken run, the making of a hole in the wall of the chicken run portrays that you are a thief.”
Kabaso admitted to committing the offence on August 9 this year.
In mitigation, Kabaso asked the court for lenience saying that he was remorseful for his actions and he was unwell due to alleged brutal beatings by the police when he was apprehended.
According to facts of the case, about 01.00 hours, Ms Florence Sikota, the complainant, who was sleeping, heard a loud bang outside when she peeped through the window, she noticed that the lights in the chicken run had been turned off.
When she went outside, she noticed that an intruder had entered her yard.
Ms Sikota started searching for the intruder and suddenly she saw him bolting through the neighbour’s yard.
The court heard that the complainant and her neighbours then gave chase and apprehended Kabaso, whom they brought back to the crime scene, where he demonstrated how he had made a hole in the wall of the chicken run with a view to stealing the chickens.
Upon conducting a head count on the chickens, Ms Sikota discovered that none of the chickens had gone missing and Kabaso was taken to Kansenshi police station for questioning in connection with the offence.
