Head Teacher Weeps In Court After Defilement Conviction
THE Lusaka Magistrates’ Court staff yesterday struggled to calm down a head teacher of Mulezi Community School who wept uncontrollably after he was convicted for defiling a 13-year-old in 2010.
Mark Mulenga, a school manager in Mutendere east who is in his 60s, was in this matter charged with one count of having carnal knowledge of a minor contrary to the Laws of Zambia.
Allegations were that Mulenga on May 13, 2010, in Lusaka, defiled a named girl who was his pupil at the school after he invited her to the school premises on the pretext that he wanted to give her books.
It was further established that Mulenga, after convincing the girl to go with him, locked her up in one of the classrooms, tied her legs and hands, undressed her before he also took off his clothes and defiled her.
According to records before court, Mulenga even produced a knife to prevent the girl from screaming and that after the act, he gave her K6 to use for transport to go to her aunt’s place in Zingalume.
It was at her aunt’s place the following day that she was noticed to have difficulties in walking.
After being checked, bruises and some whitish discharge were discovered on the girl’s private parts.
When the matter was brought before magistrate Ruth Chilembo, Mulenga denied having committed the offence and the prosecution availed four witnesses during trial.
However, in delivering her judgment, magistrate Chilembo said the prosecution had proved its case beyond any reasonable doubt to the effect that Mulenga defiled the girl.
She said there was corroborating evidence to show that Mulenga indeed committed the offence and that the court had also established that the girl’s home was near the said school.
Magistrate Chilembo said she found Mulenga guilty and convicted him accordingly but the matter was committed to the Lusaka High Court for mitigation and sentencing as the case was beyond the jurisdiction of the trial court.
It was at this point that Mulenga, who was calmly seated in the accused dock during the delivery of judgment, dropped to the floor and started crying and pleading for mercy.
A court official tried to console him and help him get up, but Mulenga cried even louder, until magistrate Chilembo ordered that he be taken away to the holding cell.
Mulenga remains in custody awaiting sentencing by the High Court.

It looks like the tendency of judges behaving the manner of General Kanene are many or its a trend within them. Did the head teacher had a laywer?
