Kitwe Pastor Jailed With Hard Labour

A 45-YEAR-OLD pastor of Rise and Shine Ministries in Kitwe has been sentenced to 18 months imprisonment with hard labour for making a value added tax (VAT) certificate without lawful authority.
This is in a case in which Roderick Kapungwe of Kitwe’s Kawama township is in the first count charged with making a document without lawful authority contrary to Section 356 Chapter 87 of the Penal Code of the Laws of Zambia.
Particulars of the case allege that Kapungwe, on dates unknown but between April and October this year, in Kitwe, with intent to deceive made a certificate of VAT registration.
Kapungwe admitted the charge when he appeared for plea last week.
According to the facts read out in court yesterday, the complainant in the matter engaged Kapungwe to obtain a VAT certificate from the Zambia Revenue Authority (ZRA) Kitwe office.
After Kapungwe handed over the said certificate, the complainant doubted its authenticity and in the first week of October this year, he visited the ZRA offices to verify its genuineness and he was told that it was not genuine.
ZRA officials then advised the complainant to report the matter to the police, which he did, and Kapungwe was apprehended and slapped with the subject offence.
Kitwe senior resident magistrate Daniel Musonda convicted Kapungwe on his own admission of the charge and the facts.
In mitigation, Kapungwe asked for forgiveness and vowed never to repeat what he did.
He said he is on anti-retroviral therapy (ART) and takes care of a big family which is likely to suffer if he is given a custodial sentence.
Magistrate Musonda noted that Kapungwe was a first offender who appeared to be remorseful for the offence he had committed.
“I will send you to prison for 18 months with hard labour with effect from your date of arrest,” Magistrate Musonda said.
Kapungwe is expected back in court on October 29 for trial in respect of the second count in which he is charged with uttering a false document contrary to the Laws of Zambia.
