Music Dispute Leads to Manslaughter

THE Kitwe High Court has imposed a six-year jail sentence with hard labour on a peasant farmer of Kalulushi for causing the death of his cousin during a fight over music.  High Court judge Chilombo Phiri convicted Phiri on his own unequivocal plea of guilty.
This is in a case in which Maybin Nsepe, 39, who on July 29 this, year in Kalulushi, unlawfully caused the death of Kelvin Kalwani, was earlier charged with murder but pleaded guilty to a reduced charge of manslaughter.
Facts before the court were that on the fateful day, Mr Kalwani was drinking beer with his two friends and the trio later decided to visit Nsepe at his house where an argument ensued between Mr Kalwani and Nsepe over music.
Nsepe got irritated when Kalwani asked him to play music so that he could dance and he reached for a stick which he used to hit Mr Kalwani on the head who fell and later died at the hospital.
