A 32-year-old security guard has been sentenced to 18 months imprisonment with hard labour by the Ndola Magistrate’s Court for assaulting his wife and knocking out her tooth.
Magistrate Ben Akende on Monday convicted David Jioma after he pleaded guilty to assault.
Jioma on November 13 this year in Ndola, assaulted Jennifer Mulibi and occasioned her actual bodily harm.
Passing the sentence, Mr Akende said it is sad that gender-based violence (GBV) cases, especially against women are on the increase despite sensitisation campaigns. .
“I have taken note of your mitigation and the fact that you are a first offender who readily admitted the charge without wasting the court’s time.
“Nevertheless, it is regrettable that violence against women is on the rise in this country and the courts should take appropriate steps to address the scourge,” Mr Akende said
He sentenced Jioma to 18 months imprisonment with hard labour and granted him leave to appeal to the High Court within 14 days.
In mitigation, Jioma begged the court to be lenient on him because he has three children with Ms Mulibi and that he is the breadwinner of the family.
Facts before the court read by public prosecutor Innocent Kamunga were that on the fateful evening around 18:45 hours, Ms Mulibi was home when Jioma arrived and questioned her on why she rebuked him for leaving his guarding post earlier in the day.
The court heard that Jioma got annoyed, punched Ms Mulibi on the mouth and knocked out her tooth.
She reported the matter to Nkwazi Police Post and Jioma was arrested.
