MMD Presidential Aspirant Sues RB,Muhabi

MMD member Tobby Maliti has sued party national secretary Muhabi Lungu and former president Rupiah Banda seeking a declaration that the adoption of the latter as presidential candidate is null and void.
According to a statement of claim filed in the Lusaka High Court principal registry with a certificate of urgency yesterday, Maliti had written to Lungu expressing interest in being MMD presidential candidate, if there was a vacancy, in the forthcoming elections after he found out from the press that president Banda had been chosen.
Maliti stated that he and other presidential aspirants had been disadvantaged by the illegal adoption of Banda. “…the second defendant has since launched his campaign despite the illegality in adoption, choosing and selection of the second defendant and despite not having followed procedure required by the MMD constitution,” submitted Maliti.
Maliti further submitted that it was illegal for the National Executive Committee (NEC) to hand-pick, adopt and sponsor Banda in the absence of a vacancy for the position of MMD president. He stated that he had suffered loss and damage and was, therefore, seeking a declaration that the meeting held by Lungu to adopt Banda was null and void.
Maliti is also asking the court for a declaration that he was entitled to an opportunity to be elected, adopted and sponsored for the forthcoming elections.
He is further seeking an injunction restraining Banda from conducting himself as a duly elected party president until determination of the matter or further order from the court.
