Kabwe Nurse Fined K5,000 For Burning Lover’s Wife

THE Kabwe Magistrate’s Court has fined a Kabwe-based nurse K5,000 for pouring hot water on the wife of her lover.
Kabwe principal resident magistrate John Mbuzi further ordered Flava Kashimbaya, 27, to pay Beatrice Limbembe K4,000 as compensation for unlawfully causing grievous harm.
Particulars of the offence are that on May 9, this year, Kashimbaya allegedly poured hot water on Limbembe when the latter visited her house in pursuit of her husband Godfrey Limbembe to collect money for school fees.
Delivering his judgment on Tuesday, Mr Mbuzi said there was no doubt that a fight ensued between Kashimbaya and Limbembe and hot water was poured on the latter.
“I will not base my judgment on the love affair that Kashimbaya had with Limbembe’s husband but the fight that arose between the two.
I do not believe that Kashimbaya accidently poured water on Limbembe as she stated that she put the pot of water on the stove to boil,” he said.
Mr Mbuzi told Kashimbaya that the state had proven its case and the court found her guilty as charged.
In mitigation, the accused’s lawyer Tutwa Ngulube said his client is a first offender and she deserved the court’s leniency.
Mr Ngulube said apart from being a civil servant and a single mother, she takes care of four dependents.
“The circumstance that led to the offence she committed happened in the privacy of her home and she sustained injuries on her body as well,” Mr Ngulube said.
Mr Ngulube said Kashimbaya was remorseful of her actions.
Mr Mbuzi said: “I have heard your mitigation and I also note that you were attacked in the privacy of your home.”

Understand the english. K5000 is for the state while K4000 is compansation to the victim who suffered burns. In total it is K9000.
