Burglar guard Jailed 18 months

A SECURITY guard of Mackenzie township in Ndola has been sentenced to 18 months imprisonment with hard labour by the Ndola Magistrate’s Court for breaking into a fire station at Simon Mwansa Kapwepwe International Airport and stealing 40 litres of diesel worth over K1,500.
Magistrate Misozi Banda on Monday convicted Consign Hamalimba after he pleaded guilty to breaking into a building and stealing diesel.
Facts before the court are that on January 25, this year in Ndola, Hamalimba allegedly broke into a fire station and stole 40 litres of diesel valued at K1,734 belonging to National Airports Corporation Limited (NACL).
“Based on your own admission of the facts as being correct, I find you guilty as charged and I hereby convict you accordingly. I have heard all you have said in your mitigation. However, the offence you are charged with is very grave and a custodial sentence would be befitting. I therefore sentence you to 18 months imprisonment with hard labour with effect from the date you were arrested,” Ms Banda said.
She granted Hamalimba leave to appeal to the High Court within 14 days.
In mitigation, Hamalimba pleaded with the court not to send him to prison as he would lose his benefits at Group 4 Security Services where he worked for more than 10 years, adding that his family had become destitutes.
Facts read in court are that Greston Mutondo, an employee of the NACL, reported on duty around 05.48 hours on the material day and as he was entering the fire station, he discovered a spillage of diesel.
The court heard that when Mutondo inspected the room,he found some containers of diesel hidden.
The accused was apprehended and taken to Simon Mwansa Kapwepwe police post where he admitted stealing the diesel, facts read in part.

Theft is theft, whether you steal a sewing niddle or a million dollar, the difference is that the one who steals a million dollar is a wise thief than the other nicocomp

I Think Before The Court Convicted Him, They Should Have Asked Him How Much Does He Get Per Month And When Was His Last Pay. The Answer Would Be K682 And 4months Has Gone No Pay. If This Is The Case, The Judge Should Have Just Said, Go Get The 40L Of Diesel Sell And Buy Food At Home You Eat And Report For Work, You Will Be Diducted On Monthed. Stealing Is Bad, But You Had No Choice, Out Of Court You Have No Case To Answer.
