GBM Goes To Court Over Expulsion
KASAMA Central member of Parliament (MP) Geoffrey Mwamba has filed an application for an interim injunction in the Lusaka High Court to restrain the Patriotic Front (PF) from expelling him from the ruling party.
This is according to a statement of claim filed in the in Lusaka High Court by Mr Mwamba.
Mr Mwamba, fondly known as GBM, wants the court to declare that his purported expulsion from the PF is irregular, null and void.
“The plaintiff [Mr Mwamba] claims an order of interim injunction preventing the defendants by themselves or by their servants or agents, from suspending or expelling him from being a member of the PF,” the statement of claim reads.
Mr Mwamba contends that he was suspended from the party last year after he resigned as Minister of Defence in preference for his support for Henry Sosala as Paramount Chief Chitimukulu of the Bemba people.
He noted that the then PF secretary-general Wynter Kabimba sat with the Northern Province disciplinary committee and decided to expel him from the party and he was only informed of this action by his sources.
Mr Mwamba also argued that the charge, suspension, notice of hearing of the recommended expulsion and the formal charge of the purported misconduct were not officially communicated to him.
“The plaintiff [Mr Mwamba]in the events leading to his suspension and recommended expulsion and subsequent expulsion, was not given an opportunity to be heard. By reason of the aforesaid, the plaintiff has suffered damage, loss and inconvenience,” the statement of claim reads.
Mr Mwamba wants the court to declare that he is still a member of the PF and MP for Kasama constituency.
He further wants the court to declare that his expulsion is illegal by reason of procedural impropriety.

Indeed GBM has the right just like any zambian citizen to seek redress where he believes he has been unfairly treated. We need to do away with the culture of where people are expelled from parties on the basis of their support and confidence in the leaderhsip of an opposition leader. Where is it stated in the PF constitution that it is illegal to endorse an opposition leader? What has one’s support of a leader got to do with his membership? Let the PF tell us which rule he broke. I do not think one’s support for another leader warrants a by-election. I know you are all going to say that the UPND has also expelled MPS. However those MPs know exactly that they broke article 9 of the UPND rules and this was communicated to them. They were not expelled for supporting Lungu

It clearly states in my comment and in the relevant news article that those three chaps broke article 9 of the upnd constitution. This was formally communicated to them. I am not surprised that they are not pursuing this legally. Shows that we follow rules unlike pf

@ educated what do u mean by suggesting that one shouldn’t be judged by the party he prefers to support …the whole idea of supporting a particular party is because u believe in their beliefs and customs..if I believe weed should be legalised for medications sake then I should join green party ..if I I believe tongas should rule and develope southern province alone and steal from the rest of the nation then I should join upnd..GBM is acting like a baby who just lost he’s toy car in the toilet now he wants it back.

Not necessarily – could be a very clever, devisive move: he may well still be in bed with UPND but what better way to destabilise PF than from within? I think the adage is “keep your friends close and your enemies closer”. It would be interesting to find out what his real motives are.
