NATIONAL Restoration Party (NAREP) president Elias Chipimo has said his party is shocked at the decision by Lusaka High Court Judge Mwila Chitabo to challenge the right and authority of President Edgar Lungu to appoint a tribunal to investigate Director of Public Prosecutions Mutembo Nchito over alleged misconduct and impropriety.
Mr Nchito has been accused of an array of charges including fraud and forgery.
Mr Chipimo said he could not comment further over Judge Chitabo’s decision to overrule the decision of President Lungu because doing so would be subjudice.
“However, we feel that the matters affecting the perceived misconduct of the DPP will only properly be settled as and when the tribunal appointed by the President is able to hear evidence and make a ruling that will always be able to be challenged in a court of law if it falls short of the expected standards of justice,” Mr Chipimo said.
Mr Chipimo welcomed President Lungu’s decision to set up Mr Nchito’s tribunal, stating that it would help to clear the DPP from the allegations he was facing.
He said a tribunal was the best way to handle Mr Nchito’s alleged misconduct and other accusations which were raised by interested parties through the courts of law.
He said President Lungu’s decision should be commended, adding that there was no any other way out apart from a tribunal.
Meanwhile, a cross section of society has welcomed the appointment of a tribunal to probe Mr Nchito.
Transparency International Zambia (TIZ) executive director Goodwell Lungu said his orgainisation was hopeful that the allegations against Mr Nchito would be put to rest.
Mr Lungu said TIZ hoped that the tribunal would also protect the integrity of constitutional offices.
“We appeal to all interested parties to use the tribunal as an avenue of settling all the issues surrounding the DPP,” he said.
Meanwhile UPND spokesperson Edwin Lifwekelo said that Mr Nchito’s tribunal was long overdue.
“We have always been very clear on Mr Nchito and that is why we objected to his appointment as DPP in Parliament,” he said.
Mr Lifwekelo said President Lungu must be commended for taking such a bold step of constituting a tribunal to investigate Mr Nchito because the suspended DPP will have an opportunity to clear his name.
Mr Lifwekelo said the appointment of Mr Nchito was objected by UPND members of Parliament and that his ratification was only made possible by one vote for the in the House.

Meanwhile, intelligence sources have disclosed that there are currently three judges that are believed to allegedly be on the cartel’s payroll, who will be expected to throw up obstacles to slow down the process against the DPP.
The intelligence sources have named the three judges as Judge Mwaka Chilombo, Isaac Chali and Mwila Chitabo.
“There are three judges that will likely bring problems. Unfortunately they can not be fired. We have to live with it,” the source alleges. “The state will continue its case and the DPP will be given his full rights to present a defence, but these judges are likely to attempt to block the tribunal from performing its duties. Their decisions should be examined closely.”

Just explain where President Lungu has gone wrong in appointing a tribunal to settle once and for all the allegations against Mutembo Nchito.Calling both President Lungu and President Chipimo Jnr all sorts of crude names will not resolve issues surrounding Mutembo Nchito.Let him bite the bullet.

I thought chipimo had a some brain cells in him. It seems PF illiteracy is an air borne disease that is affecting many people apart from the protected UPND intelligentia. What chipimo should understand is that the courts have more power than a foolish tribunal set up by an aggrieved president who wants to personally fix some one on behalf of another very corrupt former leader. Good job by the judiciary on sticking to the law of the land. If nchito did everything by the book even if it goes negatively against you, that does not make it wrong. The law is the law. Vote UPND to avoid such unnessary tribunals

Edgar and Chipimo are acting as though they are not lawyers. Let me educate you the two gentlemen. Mr Eddie, when you were voted into office, you promised us that you will not interfere with court cases. You are aware that DDP still has cases before Mwila Chitabo at the high court and the other one at supreme court of Zambia. How then do you appoint a tribunal in the same cases before the courts. Tribunal was supposed to be set before taking him to the courts of law. imagine a situation where the courts find him with cases to answer and then the tribunal acquits him.

Chipimo is “shocked” that the Judge has stayed the Tribunal? Why wasn’t he as shocked when Judge Mutuna & colleagues stayed Sata’s tribunal? What is good for the goose is good for the gander.
Let Mutembo fight the way he sees best, as long as it is within the law.
What Chipimo should be shocked about is the way ECL is trying to get rid of the DPP in order to deliver on the promise made to RB.
Mutembo, your fight is Zambia’s fight. We do not like the people who have gathered around the Presidency eg RB,Nguni and all the ‘dirty’ lawyers.

If the DPP was doing things by the book no matter how unfavorable they were to your president and his party, there is nothing you, the president or I can do about it. Judge Chitabo is just following the court process as it is laid down.The Judge never cut any corner for your own information. All my voting years, I have voted for the PF but for the first time in my voting life I am about to do something that really pains me- I am NOT going to vote for my party the PF because of the Mutembo Nchito’s saga. It stinks and smells of the president’s vindictiveness. I appalled!
I am now going to use all my little resources to decampaign my party and mobilize my 6 voting dependants to go the other way come 2016. I can not be part of this party and government. When I go on leave later this year to the village in Eastern province, I will labour night and day to persuade my tribesmen and women to discard ECL. I did that with Bwezani and using my resources I intend to do this time around.
That is a promise. Stop this nonesense before you rule for only 20 months ECL, I beg you. Whatever Bwezani gave you, just give it back and concentrate on getting the country back to its feet.
