PF Says Judge Mwila Chitabo’s Action Was Illegal
THE Patriotic Front (PF) has described as legally incorrect an action by High Court judge Mwila Chitabo to stay President Lungu’s decision to suspend Director of Public Prosecutions (DPP) Mutembo Nchito.
On Tuesday, President Lungu suspended Mr Nchito and appointed a tribunal comprising three former chief justices to probe his alleged professional misconduct.
Mr Nchito, however, applied for judicial review of President Lungu’s decision in the High Court on Wednesday and Mr Justice Chitabo granted him the request, which also acted a stay of the tribunal.
But PF secretary-general Davies Chama said in a statement issued yesterday that Mr Justice Chitabo’s action is not only illegal, but also disrespectful ,which should not go unchecked.
“It is sad to note that the judge decided to directly disrespect the Constitution by openly showing contempt for President Lungu,” Mr Chama said.
Mr Chama has called for an immediate probe by the Judicial Complaints Commission (JCC) to establish the premise Mr Justice Chitabo used to suspend decisions made by President Lungu.
Mr Chama is further calling on the Law Association of Zambia (LAZ) to investigate the alleged misconduct of both Mr Nchito and Mr Justice Chitabo who are lawyers regulated by the organisation to bring “closure onto this matter”.
He said the JCA and LAZ should immediately investigate why all matters involving Mr Nchito are allegedly allocated to Mr Justice Chitabo.
Mr Chama wondered why Lusaka High Court judge-in-charge Isaac Chali allegedly always allocates cases involving Mr Nchito to Judge Chitabo.

The reason is simple. Only judge Chitabo is the only one in Zambia who can match the brilliant thinking Mutembo Nhito.

And these are the people who are ruling us? What a waste of votes. Ati ba Chama sometimes I feel ashamed to be called a Zambian with such people governing us. Judicial system should be independent and PF boneheads should respect it. Back to Edgar all he’s been doing is firing what the phuck is wrong? Are there no developmental issues in his “In Tray” of his desk?

Meanwhile, intelligence sources have disclosed that there are currently three judges that are believed to allegedly be on the cartel’s payroll, who will be expected to throw up obstacles to slow down the process against the DPP.
The intelligence sources have named the three judges as Judge Mwaka Chilombo, Isaac Chali and Mwila Chitabo.
“There are three judges that will likely bring problems. Unfortunately they can not be fired. We have to live with it,” the source alleges. “The state will continue its case and the DPP will be given his full rights to present a defence, but these judges are likely to attempt to block the tribunal from performing its duties. WHAT IS THE STORY OF JUDGE CHIKOPA’S TRIBUNAL.WHILE THAT SET UP A PRISEDENT.LUNGU AND HIS FRIENDS CHAMA, INONGE & KALABA ABUSED THE SAME COURTS DURING PF NOMINATIONS WHEN THEY OBTAINED ERRONEOUS CONSENT JUDGEMENT.DO UNTO OTHERS AS U WOULD WANT THEM TO DO UNTO YOU.

The Country will do well not to politicize the judiciary but also the judiciary not to fall prey into politicking. For justice to prevail, let personal interests not overtake public interest. If there are singled out misfits in the judiciary, then proper management of such should be employed to reed of such out of the way. What is utmost is not to allow criminality to hide under certain clauses in the law. Justice must be for all and not only certain personalities. There is always a limit to everything.

wapya munzi.let the big wigs fight nd us junior lawyers wil be closly watching.chitabo is on firm grounds. thats what in L130 & L160 call checks and balances. the executive checks the judiciary by tribunals, judiciary checks the executive by judicial review nd quashing their decisions.so its 50:50. wapya munzi law at play.

This is law @ play,let the players show case their skills,let us all see the levels of law Literacy in this country,it is hoped that the law in this country will better many pipos lives,by being equal in justice deliverance,some pipo have gone on unchecked or untouched and getting away with it,I hope this tym we can see to it that the judiciary is working in this country,not being controlled by one individual (DPP) for his selfish interest,to protect his colleagues and Businesses(post) fuel dealers,(petroda) food and chain suppliers (zambeef) there a lot more Cartels and now its swallowed the clergy men,as such, if This is not contained,we will keep on loosing Presidents one after another because of these selfish men and women,some r even aspiring for High office,EL watch out who cooks for u,laundry,your Doctors,church mates,and work mates.u r surrounded by these bad pipo.

I miss SATA these cartel Judges would have been fired by this time Edgar is a lawyer by profession and by removing the DPP he knew what he was doing who is Mutembo Nchito! CHITAMBO here I come from south Africa you thought I would die
