Lungu Releases Tribunal Findings

Lusaka, (SUNDAY, 22ND March 2015) — His Excellency Mr. Edgar Chagwa Lungu, President of the Republic of Zambia has released the recommendations of the two tribunals appointed to investigate allegations of incompetence and, or misconduct by Justice Timothy Katenekwa and Justice E.P Sunkutu respectively.
lunguThe two tribunals were appointed in 2013 pursuant to Article 98(3) of the Constitution of Zambia as read with Section 24(1)(B) of the Judicial (Code of Conduct), Act No.13 (1999) of the Laws of Zambia.
The Tribunal on Justice Katenekwa was chaired by retired former Chief Justice, the Hon. Mr. Justice Fredrick Chomba and was assisted by the Hon. Mr Justice Bobby Bwalya (retired) and the Hon. Mr Justice L.V Siame (retired) as members.
The Tribunal recommended:
1. Not to remove Hon. Justice Katenekwa from his position as Puisne Judge of the Industrial Relations Court because he was no longer holding that position having being transferred to Kabwe as High Court Judge;
2. That charges against erring judicial officers must be brought as promptly as possible whilst they hold the office from which the charges emanate;
3. That the Judges’ workload in the Zambian courts must be given special attention;
4. That Judges on transfer must be given adequate notice in order for them to conclude cases from the stations they are transferred from;
5. That when reinstated, the Hon. Mr Justice Katenekwa must be given adequate time to complete pending cases before he can be assigned new cases;
6. That adequate resources must be provided for Judges who have pending work in other stations in order for them to wind up such work;
7. That there is need for additional courtrooms at Kabwe and that the station

The Judge Sunkuntu Tribunal was chaired by retired former Chief Justice, the Hon Mr. Justice Mathew M.M.S.W Ngulube assisted by the Hon. Mr. Justice Bwalya and Justice Siame as members. The Tribunal recommended that:
1. The Hon. Justice Sunkutu should not be removed from office as Puisne Judge of the High Court;
2. That the cases or complaints of erring judges should be promptly dealt with by relevant authorities;
3. Where case files are lost, supervisors should consider directing new trials which would be a lot less unjust than waiting indefinitely as it has turned out to be.

The two tribunals presented their findings and final reports to the President on Friday, 19th March 2015. The President will act accordingly.
In another development, President Lungu has directed that all District Commissioners whose contracts have expired must vacate office immediately. Those wishing to re-apply should do so in line with the provisions of their expired contracts.
In a letter to the Secretary to the Cabinet, President Lungu ordered that in the interim, District Administrative Officers be appointed to act in the vacant positions before new commissioners are appointed.
The President has further warned of stern action against public officers sabotaging the implementation of various development projects and advised those whose political ambitions are clouding their judgment must leave the public service.
The President has directed his Special Assistant for Project Implementation and Monitoring Mr Lucky Mulusa and all Ministers to ensure that they take personal interest in monitoring projects that were needlessly being held back. The President expects that all ministers and MPs will take advantage of rising of Parliament this month to go out to the country and bring status reports on key development projects that were launched when the Patriotic Front took power in 2011.

    Why do you always say his Excellency Mr Edgar Chagwa Lungu the president of the Republic of Zambia? I mean President Lungu can do we all know he is our president in Zambia. Dumb. All he knows is firing people. I want to hear what are the fiscal economic measures has he put in place to resuscitate our economy?

    Kiki what a joke. So could we please be told how much we wasted on tribunals that we knew would not yield anything tangible. The recommendations raised do not take a genius to figure that the judicial system in Zambia needs an overhaul. The recommendations are what the LAZ and other stakeholders should be advising. We do not need wasteful tribunals to be told what we already know. So all that money wasted would have been used to improve the lives of poor zambians somewhere. Meanwhile we have just made already rich judges even more rich. Vote UPND to remove this joke of a government

      NEZ, on this one you are right. THE JUDICIARY IN ZAMBIA IS MOST ROTTEN. What do you expect from a tribunal full of corrupt former chief justices who left office disgracefully? Ernest Sakala, Mathew Ngulube and Annel Silungwe are all corrupt and were very corrupt during their tenure of office and WILL NEVER find Mtembo Nchito guilty because they are MUCH WORSE THAN HIM. Zambians you forget so easily, was it not Ernest Sakala as CJ and Ireen Mambilima as Deputy CJ who were called stupid judges passing stupid judgments, in their own courts and they foolishly jailed the brave lawyer Nsuka Sambo and his poor and innocent client?

      This was over a straight forward land sale deal which Nsuka Sambo competently won at the high court but the supreme court overturned it on grounds of nepotism?

      This judiciary has a lot to hide, so it prefers trying Nchito in camera (away from the public eye)as if Nchito was a private DPP wa anyina wa Ernest sakala, Mathew Ngulube or Ireen Mambilima.

      President Lungu has missed it on the judiciary as he should have put Supreme Judge Mumba Malila to be Chief Justice not Ireen Mambilima who was schooled on how to be corrupt by Ernest Sakala who was also a deputy to the corrupt Mathew Ngulube. Mumba Malila is clean enough to be CJ not the corrupt Mambilima who clearly did not want the tribunal to go on and she instructed the corrupt judge to block the trbunal. So nothing will come out of this tribunal full of dead wood. Iam PF but on this one, President Lungu is off side.

    Why is this Lungu avoiding issues of the economy, Kwacha or even investors but very busy rearranging furniture in the Govt and waiting for any invitation outside Zambia? In only 3 months he has visited 6 countries! More than Sata did in his entire presidency. PF should be ashamed for the mess we are in.

    Mr. President, please clear the air on the mines. This is one of the major issues bringing the kwacha down. Be categorical and not those statement that Yaluma is releasing that are neither here nor there. Be courageous and state in clear terms if the 20% tax has been reversed. Make a categorical policy statement about the mines to calm the investor anxiety. Why should this issue drag on perpetually? THis will be more important than what Kalyalya will do.

    Under first Presidend KK, we had Commissions of Inquiry which used to be very investigative in its reporting.
    Now we have what I may call hopeless Tribunals. In the case on hand,this tribunal just looked at the conditions of service and reported that these must be improved-what a waste of resources! I hope all these retired jusices had clean hands as I still remember one Mr Justice Mathew MMS Wataba Ngulube confessing to having benefited from the Zamtrop account with US$35,000.00.Amfumu, Kodi munabweza izi ndalama ku Boma?

    @New Educated Zambia.I used to be a UPND member under Anderson Mazoka. After the demise of Andy, the new leader had very poor management skills or lack of it that I had to wean myself from UPND.

      Poly you have freedom of speech and choice of political affiliation based on whatever temperamental feelings you have depending on the time of the month. However, it could help if you could give us examples of the leaders poor skills or lack of as you put it? Also, I find it interesting that you claim to have weaned yourself from the UPND and yet have gone on to follow a party whose president lacks vision, who has caused the worst perfomance of the kwacha in time memorial and the list goes on. Am sure we do not share the same idea of what sound management is. Hopefully you find yourself in future and deal with your personal inner issues. We will always be here for you. Forward
