President Lungu Makes Changes To Retirement Age Law

LunguShanghai, China (FRIDAY, 27th March 2015) — In line with his campaign promise during the run up to the January 20 presidential election, His Excellency Mr. Edgar Chagwa Lungu, President of the Republic of Zambia has directed the Ministry of Justice to immediately revise the law on retirement age to provide for three options an employee can exercise to retire.

The President has directed that the following changes be effected through an amendment to Statutory Instrument No.63 of 2014 to introduce a graduated arrangement that will afford employees the following options:

(a) Early Retirement – 55 years
(b) Normal Retirement – 60 years
(c) Late Retirement – 65 years

Accordingly, the Secretary to the Cabinet has since informed the Ministry of Justice Permanent Secretary Mrs. Patricia Jere to prepare the Statutory Instrument and to liaise with the ministries of Local Government and Housing and Labour and Social Security to amend the LASF Act and NAPSA Act respectively to reflect the revised retirement ages.

“The revised Statutory Instruments should clearly indicate that those who were employed before the effective date of the new Statutory Instruments will have the option of proceeding on either early retirement, normal retirement or late retirement as a way of securing their accrued rights,” directed the Head of State.

Those employed in the public service after the issuance of the said Statutory Instruments will only qualify for normal retirement at the age of 65.

The President’s order therefore necessitates the urgent need for the passage of the Social Security Bill into law.

Next day the chap has gone on to change this. Another case of a clueless government that lacks continuity certainty in approach.       By covering all levels it does not deal with the issue of ineffiency and unemployment in a country with a low life expectancy. Even those that become inefficient due to age wull continue on because they feel like and out of poverty to keep working. This is a sign of a government that cant make a definite decision because they have no idea or clue what is the best way forward. Retirement age can not be based on levels. How are you the government and other firms supposed to plan and have certainity in investing in pensions without a definite time frame on when such moneys will be needed to be taken out the system? kiki vote upnd

Lungu has changed nothing and this will cause more havoc in pensions management. The substance of the issue is that retirement urge has remained 65 years only that this time it has brought confusions.

      You see confusion where there are provisions for contractual accommodation. I’ll be brief. Those that started work b4 this law had signed the contract with govt ending when they reach 55.         Yes its straight forward those employed before implementation of this amendment to Statutory Instrument will have 3 options however those comes after then they maintain the 65 years limit. There is also a catch for companies that have already put in place a retirement package for a man who is to retire at “normal age” only for old madala to say I want to go the whole 9 yards – companies needs to re-regulate their policies and adjust the packages.

    @SUPERHUMAN…you got it wrong.This one was enacted in reverse and Mactribouy was locked up without bail.You may also appreciate that this law was schemed and designed by the FTJ Institute to fix the said chap.The chap eventually gave in and died before FTJ. I now put my case to rest.

    poor superhuman effective date of the law is declared in the same stating its effective on its been declared ie date of assent on may start retrospectively or in future by a statutory instruement. therefore its not wrong in its effective date. the law is not ambigous its clear take it as it is period.
