A 30-YEAR-OLD man of Siavonga has been sentenced to five months simple imprisonment for slapping his wife after discovering that she was living with HIV.
Before magistrate Victoria Chitulangoma was Justine Kabanje, a resident of Kanyelele compound, who was charged with one count of assault contrary to the Laws of Zambia.
It was alleged that Kabanje on February 17 assaulted Rita Chinduma after a dispute. In mitigation, the accused asked for the court’s leniency, saying he was a breadwinner.
The sentence is with effect from March 15. During trial, Kabanje had told the court that he slapped his wife after he discovered that she was HIV positive and had been taking antiretroviral treatment for five years. “I felt bad because alemfisa (she was hiding this from me) all this time.
Not only that, my wife likes sleeping with other men,” Kabanje told the court.

No she was totally wrong that’s a life and death issue which can affect even innocent children born from the marriage now there he goes to jail for a mere slap besides possibly infected too – that was a wrong judgement. In my court only a caution would ve been laid on him.

The country and the legal system is only acting naturally to the terrible record of HIV which the government has failed to tackle on all fronts of the paradigm of reducing hiv infections. The legal system reflects this in the sense that one would have thought by now our legal system would have criminalised the intentional infection of others with this disease. It seems it is normal now to get hiv and even the courts see no offence in intentional infections. Then the pf will come out and say in 90days we have achieved alot kiki. vote upnd bane

Every Zambian nowadays understand the law. But on this case the poor Magistrate was 100% unfair. Surely how can you punish an innocent person like that.
Our justice sytem need a big resecue otherwise other wicked people like edgar lungu can be using it for punishing opponents.
The president should consider realising that man tomoro and the stupit judge Chitulangoma should have her pants burned in fire. Very stupit judge. release the innocent man.
