Pilato Saved: Case Fails To nTake Off

pilatoTHE case in which musician Chama Fumba, popularly known as Pilato is charged with conduct likely to cause breach of peace for causing his song “Alungu Anabwela” to be published on online media, today failed to take off because the State failed to avail witnesses before Court.

When the matter was called up before Chief Resident Magistrate Aridah Chuulu,

State Prosecutor Mr. Like Pumulo told Magistrate Chuulu that the matter would not proceed because there were no witnesses.

“Your honour we are not ready to proceed because, we have no witnesses,” he said.

    No need to waste state resources on someone like Pilato. There’s was just too much fuss about nothing. Leave him to make a living the best way he knows best as long as he doesn’t break the law.

    Yes @Czar, that’s th0e way to go. Especially when method 2 (The Kanene-Dimba colarbo) seems to have sorted out Plato’s idiocy.
    Actually, the real idiocy is on the arresting officer who went ahead to arrest a person with ZERO witnesses. How did they effect their arrest knowing that no one’s peace was breached? It is actually Pilato who can make a buck by suing the state for breach of his peace over nothing!

        Cite that law in the Laws of Zambia. Breach of peace should be accompanied by a public complaint hereto also referred as state witnesses. Besides that song was basically an online song, so whose peace was breached? The state will end up looking stupid if not already guilty of my assumption.

    I can garantee u as a legal mind there is no locus standi in the case.nd pilato can sue for malicious prosectution if the state is not careful

      No my friend the Court has the right to execute locus standi as Pilato falls within their jurisdiction and him also has the right to be heard in court, the case is a Prima Facie as from the look of things there is no evidence against the accused.

    This Government is not serious….prosecuting a musician over a song is just shameful….some of these things is just to let sleeping dogs lie….Anyway I am not surprised because the truth hurts.
