KABWE High Court Judge-in-charge Dominic Sichinga has sentenced two men of Kabwe to death by hanging and acquitted a juvenile after finding them guilty of aggravated robbery.
Bernard Chanda 29, George Phiri, 30 and a juvenile appeared before Judge Sichinga when the matter came up for judgement.
In delivering judgement, Mr Justice Sichinga said he was satisfied that the state had proved its case against Chanda and Phiri but there was no evidence pointing to the juvenile.
“The prosecution called five witnesses and I have carefully considered the evidence before court,” Mr Justice Sichinga said.
Particulars of the offence are that on May 23, this year in Mkushi, Chanda, Phiri and the juvenile jointly and whilst acting together with others unknown and whilst armed with an AK47 assault rifle did steal from Danny Sikapizye K96, 000 cash and two cellphones all valued at K96,140.
Other particulars are that immediately before or immediately after the time of the crime, the trio did use actual violence on Mr Sikapizye to obtain the said property.
The offence is contrary to section 294 (2) of the penal code chapter 87 of the Laws of Zambia.
In passing judgement, Mr Justice Sichinga told Chanda and Phiri that the courts hands are tied looking at the offence they committed.
“In assessing evidence, the court found that Chanda and Phiri failed to give an account on what accrued on the actual day,” Mr Justice Sichinga said.
Mr Justice Sichinga then handed down the death penalty to Chanda and Phiri.
“May God have mercy on your soul,” Mr Justice Sichinga said.

There is no need to support crime anywhere in the world but death sentence seems to be too much for the two gents. If only it was attempted murder or they had killed someone, yes they could have been slammed with such punishment. Hopefully they can appeal.

Zambian legal system is now a joke. This is what happens when you have a president who is a visionless lawyer. Lungu has given the wrong influence to the legal system. Surely how do these guys get death sentence meawhile criminals like kaizer zulu and chi chama are busy walking around free while terrorising zambians. The real criminals are the pf cronies who have led to people starving and suffering. COme 2016 when UPND forms government we will ensure that the law visits you.

The judge is correct, he said his hands were tied. The judgment is correct, remember this issue of aggravated robbery had escalated in Zambia some years back and people wanted such criminals to get death sentence. So it is not the judge, its not even ECL, it is the law which we as Zambians collectively put in place.

We are saying,Zambia is a Christian nation but do we have such kind of penalties. I see it not to be good,better jailed for long priod,that can give one a chance to repent.

Bring them to Botswana. We will hunt for them and exterminate them by shooting. That is equivalent to death sentence. I guess your judge is right. He was passing a second death sentence on those thieves. The first one could have been kill them by shooting but the time they were cornered at apprehended did not allow. In fact they are lucky to have lived a bit longer.
