Five UPND members including Former Lusaka province minister Obvious mwaliteta have been acquitted on three counts of aggravated robbery.
High court judge Mwape Bowa has Mwaliteta and four others as the prosecution has failed to prove the case against them.
Judge Bowa says there is no evidence linking the accused to the commissioning of the offence.
He says no weapons were found on them or stolen material to prove that they took part in the offence.
The court says the arresting officers evidence was so much discredited such that he failed to investigate the alibi of mwaliteta’s co accused that they were not at the scene of crime when the attack was happening.
Judge Bowa says Mwaliteta’s presence at ECZ was for election business purposes being a known political figure and infact there was nothing unusual about him being found at ECZ as the country was awaiting the announcement of the presidential results.
And immediately after Mwaliteta and Evans Mukobela were acquitted after the other three were acquitted at first,Melissa who is Mwaliteta’s daughter collapsed as was quicky lifted through the other entrance.
