Respected Political Analyst Neo Simutanyi says President Edgar Lungu’s advise to his Ministers to disregard the court’s verdict and avoid paying back the money they illegally got from the Zambian people is enough ground for parliament to begin his impeachment process.
And Dr Simutanyi says the Constitutional Court was wrong by failing to find President Lungu guilty of violating the Republican Constitution because he misled his ministers to continue to execute their duties when Parliament dissolved ahead of the 2016 polls.
Clouds of uncertainty waves on the Constitutional Court ruling following revelations by the local tabloid that President Lungu instructed the 64 erring Ministers to ignore the Constitutional Court ruling.
Sources who attended the last Cabinet meeting disclosed that the President told his ministers to ignore the Constitutional Court judgment.
“During the cabinet meeting ya this(last) week, ija nkhani yama Ministers paying back the money they received came up. Kaili these Ministers, some of them have argued that they did not stay in office at their own will, they were instructed by H.E, so how should they be made to pay. So the President told them to ignore the Concourt judgment, just like that. He even said the Ministers should not pay back and should actually sue the state,” the source said.
When reached for a comment, Dr Simutanyi said he hopes President Lungu was misquoted.
“If it is true that (President)Edgar Lungu said his Ministers are not supposed to pay back the money, it is a serious breach of oath of his office, which calls for his impeachment. As far as I am concerned, the President is supposed to protect the constitution and respect the outcome of the court but he is in the forefront violating the constitution by not respecting the judgment of the court which is final” Dr Simutanyi said.
And the political analyst known for his object opinion polls, called for the impeachment of President Lungu for violating the constitution.
He said President Lungu should take full responsibility of his Ministers’ guilt verdict because he is the one who misled them to continue occupying office after the dissolution of parliament.
“It was irresponsible for Edgar Lungu to say that and I hope he was misquoted. If anything, it is Edgar Lungu who was wrong when he told his ministers to continue occupying office against the constitution. The Constitutional Court was wrong not to have found him guilty of violating the constitution.
Dr Simutanyi called on the Law Association of Zambia(LAZ) and other reputable organizations to take President Lungu’s breach of oath case to court.
“The Law Association of Zambia or whoever should go to court and say that the President should be answerable for violating the constitution. His Ministers have been ordered to pay back the money and it is unfair but they have to pay. However, the person who misled them to disregard the law should not be left free. We know he cannot be prosecuted but parliament can begin the impeachment process,” Dr Simutanyi said
Is our parliament mature enough to embark on such. Remember some of the said ministers are still there. If this is true, then Lungu has totally lost it especially that he is a lawyer
